NOTICE OF VIOLATION Toledo Edison Company Docket No. 50-346 As a result of the inspection conducted on March 13-17 and April 18, 1989, and in accordance with 10 CFR Part 2, Appendiv C - General Statement.of Policy and Procedure for NRC Enforcement Actions ( 988), the following violations were identified:

Paragraph 2.C(4) of Amendment No. 18 to Plant Operating License No. W F-3 requires the licensee to complete those modifications identified in Section 1 of the Safety Evaluation (SE) dated July 26, 1979, including those modifications specified in Table 1 of the SE.
Section B.14 of Table 1 of the SE requires that the fire protection administrative controls be revised to follcw the NRC document, " Nuclear Plant Fire Protection Functional Responsibilities, Administrative Controls and Quality Assurance." Paragraph 2.0 of Attachment No. 6 to this document states in part, "... administrative controls...
that govern the fire protection program shall be prescribed by documented instructions (and) procedures." Further, Attachment No. 5 states, in part, that "the fire fighting procedures should identify... the need for brigade assistance upon... receipt of an alarm on the control room annunciator panel...."
Contrary to the above, Procedure No. AB 1203.37, " Fire Procedure,"
did not prescribe the need for fire brigade assistance upon receipt of an clarm in the control room. This allowed an unacceptable time delay in fire brigade response to a fire through the licensee's established practice of dispatching an individual to an alarmed area without assembling the fire brigade after the annunciation in the contrul room of the activation of a fire alarm.
This is a Severity Level IV violation (Supplement I) (346/89012-01(DRS)).

Paragraph 2.C(4) of Amendment No. 18 to Plant Operating License No. NPF-3 requires the licensee to complete those modifications identified in Section 1 of the Safety Evaluation (SE) dated July 26, 1979, including those modifications specified in Table 1 of the SE.
Section B.14 of Table 1 of the SE requires that the fire protection administrative controls be revised to follow the NRC document, " Nuclear Plant Fire Protection Functional Responsibilities, Administrative Contrcis and Quality AstvP'ince." Paragraph 8.0 of Attachment No. 6 to this document requires, i: part, that conditions adverse to quality be promptly identified and corrected.
Contrary to the abnve, Toledo Edison Company failed to assure that corrective actions tak.en in response to a previously identified Severity Level 'V violation (failure to establish required fire watches) were adequate in that on November 17, 1988, and January 12, 1989, the licensee failed to establish continuous fire watches within one hour as required by Technical Specification 3.7.10.a.

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each violation:
(1) the corrective actions that have been taken and the results achieved; (2) the corrective actions that will be taken to avoid further violations; and (3) the date when full compliance will be achieved.
Consideration may be given to extending your response time for good cause shown.
