LICENSEES' MOTION TO DISMISS CONTENTIONS 2.l(s) and 2.l(d)

Pursuant to 10 C.F.R. S 2.707 (1982), Consolidated Edison Company of New York, Inc. and the Power Authority of the State of New York, licensees of Indian Point Units 2 and 3, respectively, hereby move this Atomic Safety and Licens-ing Board for an order dismissing Contentions 2.l(a) and 2.l(d).

The grounds for this motion, which are more fully set forth in the accompanying memorandum, are that the actions of the sponsoring intervenor for these contentions, UCS/

NYPIRG, have prejudiced the licensees by denying them their 8301100189 830106 PDR ADOCK 05000247 0 PDR

right to complete preparation of their case, and, therefore, have denied them administrative procedural rights and due process of law.
