Dear Judges Gleason,
Shon, and Paris:
Enclosed is the Licensees' Motion to Dismiss Contentions 2.1(a) and 2.l(d), and a memorandum in support thereof.
The motion requests dismissal of these contentions because the refusal of UCS/NYPIRG to make Dr. Gordon Thompson and Mr. Steven Sholly available in a reasonable manner for the continuance of their deposition has prejudiced the licensees by denying them their right to complete the preparation of their case and, there-fore, has denied them administrative procedural rights and due process of law.
Because the licensees' written testimony on Commission Question 2 is due on January 12, the licensees request that the Board act expeditiously upon this motion.
