On October 4,1981, the New York State Assembly and its Special'Cornmittee.on Nuclear Power Safety petitioned to intervene in these proceedings as an interested state.

The health, welfare and safety of the citizens of New York State, whom the members of the New York State Assembly are elected to represent, is dependent upon the ,

existence of effective emergency planning to prevent health and other consequences in the event of a radiological emergency at Indian Point. These citizens are concerned about the acequacy of emergency planning, apart from their concerns about the probability of an accident at the plants.

The New York State Assembly and the Special Committe on Nuclear Power Safety support the propo:al of the Union of Concerned Scientists and the New York Public

Interest Research Group that the Board consider accident consequences and emergency 1

planning as the first order of business in the upcoming investigation of the Indian Point pOs 3

nuclear powerplants (see UCS/NYPIRG Response to Objections to Contentions, Point 1(E),

pp. 7-8). The New York State Assembly has intervened in the investigation as an interested state pursuant to 10 CFR 2.714 and 2.715(c).

Additionally, consideration of emergency preparedness and planning as the first order of business would be administratively expedient, allowing allissues of concern to be discussed in full length within the prescribed time frame.

The Assembly therefore urges the Board to schedule hearings on the accident consequences and emergency planning at the earliest date and to provide for sufficient time for a full presentation of evidence.
