Thank you for your March 12, 2014 letter offering the opportunity to comment on the above referenced project. The Nuclear Regulatory Commission (NRC) has requested my input on the preliminary determination that the decommissioning of Unit 3 will not adversely affect any historic sites and cultural resources.

Per Section 106 of the National*Historic Presetvation Att (NHPA) and its implementing regUlati~nrsfound at,36 CFR Part 800, any federaLundertaking must take into account the effects of the undertaking on historic properties and afford the Advisory Council on Historic Preservation the reasonable opportUnity to comment on the undertaking. As the NRC is amending a license, Which includes the decommissioning and dismantling of remaining on-site facilities,"it meets the! definition of an undertaking' asý defined in 36 CFR Part :800:16(y). Unit 3 was commissioned in 1963, making it: overO0years old. This is the'standard threshold-for evaluating properties part of a federal undertaking for potential eligibility to the National Register of Historic Places. Additionally the project will involve ground disturbance, raising the potential for affecting archaeological resources.

It is Unclear from your letter whether the NRC intent is to initiate Section 106 consultation with my office at this time. Additionally, your letter indicates that the NRC intends to use 36 CFR § 800.8 to meet its Section 106 responsibilities. However, the letter does not indicate which section of 36 CFR § 800.8, subsection a, b, or c, it intends to use. Please clarify which section the NRC is intending -to use. The Use of the 36 CFR § 800.8 process requires the careful coordination of the NEPA and Section 106 reviews and includes of the SHPO at each stage of the NEPA process.

If the NRC is proposing to Use 36 CFR § 800.8, please contact my staff immediately to discuss the -undertaking, establish.a coordinated schedule for review, and documentation requirements.

I also suggest you review the Advisory Council on Historic Preservation's guidance, NEPA and NHPA: A Handbook for IntegratingNEPA and SeCtion 106, available on their website (http://www.achp.gov/docs/NEPANHPA_.Section_ 106_Handbook-Mar2013 pdf).

Due to the lack of information provided :by the: NRC ýregatding potential historic properties, I am unable to"comment on the>NRC's.prelimiriary determination that the undertaking will not adversely affect any historic sites and cultural resources at this time. As the Humboldt Bay

Mr. Andrew Persinko NRC_2014_0317_001 April 10, 2014 Page 2 of 2 Power Plant Unit 3 is over fifty years old, the potential National Register eligibility of the property will need to be evaluated. Please also identify any other federal agency/s that will be involved in the undertaking.
