CORRECTION TO LICENSE NUMBERING: HUMBOLDT BAY POWER PLANT, UNIT 3 - ISSUANCE OF LICENSE TERMINATION PLAN AMENDMENT (EPID: L-2021-LLA-0012)

Dear Mr. Welsch:

On June 24, 2021, the U.S. Nuclear Regulatory Commission (NRC, the Commission) issued Amendment No. 46 to Facility Operating License No. DPR-7 for the Humboldt Bay Power Plant, Unit 3 (HBPP). The amendment consists of changes to the HBPP license in response to your application dated February 8, 2021 (Agencywide Documents Access and Management System

[ADAMS] Accession No. ML21039A515), as supplemented by letters dated April 29 (ADAMS Accession No. ML21119A214) and May 20, 2021 (ADAMS Accession No. ML21140A395).

Specifically, the amendment revises the HBPP license by revising License Condition 2.C.5.

This license condition incorporates the revised License Termination Plan into the HBPP license.

This letter is to inform you that the issuance of the amendment number was incorrect. The previous project manager issued license Nos. 45 and 46 out of sequence. License Amendment No. 46 was issued September 23, 2015 (ADAMS Accession No. ML15148A361) and License Amendment No. 45 was issued May 4, 2016 (ADAMS Accession No. ML15090A339). The next amendment number should have been No. 47, as opposed to No. 46. This error was an inadvertent administrative error. The NRC staff has corrected the error. This correction is needed because without a correction there would be two distinct amendments with the same amendment number. All other aspects of the license remain the same.

It can be demonstrated that the error was introduced inadvertently in license amendment, was not requested by the licensee in its application, and that the erroneous change was not addressed in the notice to the public nor reviewed by the staff. Under these circumstances, the change that introduced the typographical error was not a proper amendment to the license because it was neither addressed in the notices nor reviewed, and correction of the typographical error is not a change to the staffs determination of no significant hazards or conclusions in its safety evaluation report. The change introduced by the error was in fact improperly made.

Accordingly, consistent with guidance (ADAMS Accession No. ML103260096) and Staff Requirements Memorandum dated December 17, 1996 (ADAMS Accession No. ML003754054), the typographical error is corrected by this letter, instead of an amendment to the license.

J. Welsch A copy of the changed pages with the administrative error corrected for License No DPR-7 is enclosed (enclosure 2) and is effective immediately. All reference to amendment No. 46 in the Safety Evaluation are now changed to No. 47. All other aspects of the safety evaluation remain the same. If you have any questions, please contact me.
