U.S. NUCLEAR REGULATORY COMMISSION INSPECTION REPORT 70-1151/

2019-401 AND NOTICE OF VIOLATION

Dear Mr. Annacone:

This refers to the inspection conducted on November 18-21, 2019, at the Westinghouse Electric Company site in Hopkins, SC. The purpose of the inspection was to determine whether activities authorized by your license were conducted safely and in accordance with Nuclear Regulatory Commission (NRC) regulatory requirements. The enclosed report presents the results of this inspection which were discussed with you and members of your staff, during an exit meeting held at the conclusion of the onsite inspection on November 21, 2019, and a second exit meeting held telephonically December 17, 2019.

This inspection examined activities conducted under your license as they relate to public health and safety, and the common defense and security, and to confirm compliance with the Commission's rules and regulations and with the conditions of your license. Within these areas, the inspection consisted of selected examination of procedures and representative records, observations of activities, and interviews with personnel.

Based on the results of the inspection, the NRC has determined that two Severity Level IV violations of NRC requirements occurred.

The violations were evaluated in accordance with the NRC Enforcement Policy. The current Enforcement Policy is included on the NRC's Web site at (http://www.nrc.gov/about-nrc/regulatory/enforcement/enforce-pol.html).

this transmittal document is decontrolled.

Annacone 2 The violations are cited in the enclosed Notice of Violation (Notice) and the circumstances surrounding them are described in detail in the subject inspection report. The violations are being cited in the Notice because these violations were not licensee-identified as would be required for a non-cited violation per the NRCs Enforcement Policy, Section 2.3.2.

You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. If you have additional information that you believe the NRC should consider, you may provide it in your response to the Notice. The NRCs review of your response to the Notice will also determine whether further enforcement action is necessary to ensure compliance with regulatory requirements.

The enclosed inspection report contains Security-Related Information in accordance with 10 CFR 2.390(d)(1) and its disclosure to unauthorized individuals could present a security vulnerability. Therefore, the material in the enclosure will not be made available electronically for public inspection in the NRC Public Document Room or from the NRCs document system (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html. If Security Related Information is necessary to provide an acceptable response, please mark your entire response Security-Related Information in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1).] In accordance with 10 CFR 2.390(b)(1)(ii), the NRC is waiving the affidavit requirements for your response.
