Dear Sir or Madam:

Pursuant to Section 552 of Title 5 of the United States Code and Part 9 of Title 10 of the Code of Federal Regulations promulgated thereunder, we hereby request that you make avail-able to us for inspection and copying the following records:

1. All correspondence , memoranda, excerpts from minutes of the Subgroup on Nuclear Export Coordination, and other records generated during the period .anuary 1, 1976 to the present, and in the possession, custody or control of the Nuclear Regulatory Commission

(" Commission") , which relate in any way to any of the following export license i.oplicatiors submitted by West.inghouse Electric Corpotation to the Commission: License Application No. X R-12 0 , dated November 18, 1976; License Application No. XCOM-0013, dated August 3, 1978; License Application No.

XSNM-1471, dated March 6, 1979.

2. All staff recommendations, correspondence, memoranda and other records generated during the period January 1, 1976 to the present, and in the possession, custody or control of the Commission, which relate in any way to:

(a) Any procedures which should be applied to appli-cations for export licenses for f acilities, components or fuel for use in a nuclear power plant.

3. All other records generated during the )eriod January 1, 1976 to the present, and in the posses-sion, custody or control of the Commf.ssion, relating to the Philippine Power Reactor Project.

As used in this request, the term " re cord" includes, without limitation , any document, writing, photograph, sound or. magnetic recording, drawing, or other similar thing by which information has been preserved, f rom which the information can be retri ved and copied. The term includes informal writings (such as hand-written notes, drafts, and the like), and also includes infor-mation preserved in a form which must be translated or deciphered by machine in order to be intelligible to humans. The term includes documents and the like which were created or acquired by the Commission, . its predecessors , its officers, or its employees by use of Government funds or in the course of trans-acting official business.

In accordance with the Commission's regulations, please identify all records covered by this request that you do not provide in response hereto and, with respect to each, please state the reasons for withholding the record.

Please be advised that we will reimburse the Commission for proper charges incurred in responding to this request up to the amount of $1,00 0. 00. Please advise us immediately by tele-phone if and when proper charges in this amount have been incurred. If you anticipate that charges will be in excess of that amo un t , please advise us immediately by telephone of the probable charges.
