Group for U.S. Reactor Exports: We, the undersigned urge the NRC to deny all Westinghouse applications for license exports of a nuclear plant, its components and fuel to the Philippines for the following reasons: i

1. The fact that the Philippine nuclear plant is situated 5 miles from Mt. Natib, a potentially explosive volcano, according
   ,      to a study by the International Atomic Energy Association-(IAEA).
2. The fact that the Philippine nuclear plant is plagued with siting, reactor design, environmental, human rights]and socio-economic problems. Especially alarming is the NRC staff finding that:

a) the plant is located near an active volcano AU b) the plant site has a long history of intense seismic activity f 4\ ( c) the orientation of the plant's turbine generator presents unacceptable risks d) the plant is only 10 miles away from U.S. Subic Naval Base.

3. The fact that there are 45 million Filipinos and including at least 8,000 Americans (residing in Subic Na. val Base), who are potential victims of nuclear accidents.
4. The fact that more than 50,000 Filipinos have risked their lives in signing a petition to Marcos opposing the plant construction. The Philippine dictator is a universally acknowledged human rights violator, which the U.S. State Department is in concurrence with.
5. The fact that more than 6,000 Filipinos have urged the NRC to deny the export license to Westinghouse.
6. The fact that spent fuel from the Philippine plant is likely to be returned to the U.S., no full Environmental Impact Statements (EIS) nor a detailed health and safety analysis has yet been done as required by the amended Atomic Energy Act of 1954.
7. The fact that the Westinghouse pay-off scandal amounting to $35 million still remains unsettled by the U.S. Justice Department.

Under these conditions, I feel strongly that Australia 1 should not sell uranium to fuel such a nuclear power plant. Nuclear Regulatory Commission Washington, DC , The Commissioners: We are appalled at your decision to grant the license to the Philippine reactor. We find it illogical that the NRC should find it has no. authority to investigate the environmental impact of a U.S. nuclear product on the Philippines. To say that' "it would.. interfere with the internal affairs" of the Philippines, if the NRC were to do so, is simply irresponsible. If indeed, the NRC were. concerned with interference on the sovereignty of another nation, then it should ask why the Carter Administration and the State Department allowed the sale and loan of $600 Million

    'from Exim-Bank in the first place?           The Filipino people have been opposed to the construction of the reactor, but it has been made possible courtesy of the U.S. government, is not that interfering with the sovereignty of another nation?           Certainly, you must recognize that there is an internal conflict within the Philippines over the issue. The NRC has recognized all along that there are dangers posed by the nuclear plant construction, yet it is allowing itself to be used by a repressive and dictatorial regime in manipulat-ing the destiny of the Filipino nation.

The NRC 'should ask itself, what is it really supposed' to do? Yes, what what are you really supposed to represent? health and safety interest and environmental conerns? Perhaps you think you have fooled a lot of people. Well, we should let you know that we now see your interests coincide with the nuclear industry's and you are nothing but a buffer blinding the people's opposition to nuclear expansion. You pretend to be ne'utral and objective. The Philippine case is a, clear cut violation of that principle--the NRC policy evaluation of January 15 suggest' that all uncertainties about seismic volcanological and ceotechnic features of Napot Point site have not been completely resolved. Moreover, the report stated that a 3-Mile Island type ac6ident is definitely low but not nececsarily remote." The NRC is issuing the license is irresponsible, illogical and unreasonable.
