Pursuant to 5 U.S.C. S552 and 10 C.F.R. pt. 9, subpt. A, I hereby appeal the partial denial of my Freedom of Information Act

("FOIA*) request to the Nuclear Regulatory Commission ("NRC")

dated August 1, 1979 ( Attac hment 1) . The partial denial of my request is contained in a letter to me from J.M. Felton, Director, Division of Rules and Records, Of fice of Administration, and bears a date of September 6, 1979 ( Attac hnent 2). The partial denial was received in my of fice on September 7, 1979. The f acts and arguments in support of this appeal are set l forth below. '

My FOIA request of August 1, 1979 requested the NRC to make i available for inspection and copying all records from January 1, 1976 to the present relating to: certain license applications .

submitted by Westinghouse Electric Corporation to the NRC; y 7

procedures and policies applicable to certain types of export licenses concerning nuclear powerplants; and the Philippin3 Power

  • Reactor Project. On August 27, 1979, I received a letter dated g August 23, 1979 ( Attachment 3) which contained a partial response /

to my FOIA request. In its response, NRC made available 60 t documents covered by the request; withheld one document which it claimed was exempt from disclosure under the FOIA; and stated (

p that it would continue to " search for and review documents not .

already identified. . ." [

i A f urther response was received from the NRC dated September 6, 1979 which made available an additional twenty-nine documents and portions of a thirtieth. Nine documents and portions of a tenth were withheld as exempt under the FOIA. All of these documents were claimed to be covered by Exemption 5 of the FOIA, 5 U.S.C. 5552(b)(5), [

and the corresponding provision of the NRC's regulations under the FOIA, 10 C.F.R. S9.5(a)(5). In addition, ,

one of the documents was claimed to be exempt under Exemption 1 of the FOIA, 5 U.S.C.

of the NRC's regulations, SS52(b)(1),

10 C.F.R.and the corresponding provision S9.5(a)(1). The September 6, l 1979 letter contained appendices which identified the documents '

withheld, including a very brief description of their subject-matter. The letter advised that an appeal might be taken of the partial denial of my request within 30 days from the receipt of the letter.1/ i 1/ The partial denial of September 6, 1979 stated that the  ;)

appeal was to be addressed to "the Secretary of the '

Commission" . NRC's regulations under the FOIA, however, provide that the appeal be made to the Executive Director for l Operations, 10 C.F.R. 59.11. In order to avoid any j misunderstanding, this appeal is addressed to both the Secretary of the Commission and the Executive Director of Operations and is being hand-delivered to both today. l l

A. Exemption 5 1

Exemption 5 operates to exempt from disclosure under the FOIA " inter-agency or intra-agency memorandums or letters which would not be available by law to a party other than an agency in litigation with the agency." 5 U.S.C. S552 ( b) (5) . This exemption has been interpreted by the Supreme Court to cover only materials developed by federal agencies which reflect

" deliberative or policymaking processes." EPA v. Mink, 410 U.S.

73, 89 (1973). Matters which are f actual in nature are not covered by the exemption, even though they may be used as the basis for agency deliberations. See, e.g., id. ; ,Vaughn v. Rosen, 523 F.2d 1136, 1144-45 (D.C. Cir 1975); Dworman Bldg. Corp. v.

GSA, 468 F.Supp. 389, 392-93 (S.D. N.Y. 1979). In each case the Government has the burden of proving that the exemption applies. See, e.g., Vaughn v. Rosen, supra at 1144; Dworman Bldg. Corp. v. GSA, supra, at 392.

With respect to documents 1, 7, 8, and 9 of Appendix B and portions of document 30 of Appendix A, the partial denial of September 6, 1979 states that Exemption 5 aopli as because the documents are "predecisional in that they diset ss matters pertaining to a license application under cons:.deration by the Commission." The mere facts that these docume. ts are predecisional and pertain to a pending license application, however, do not justify withholding under Exemption 5. As the Court of Appeals for the D.C. Circuit stated in Vaughn v. Rosen, supra at 1144, " pre-decisional materials are not exempt merely because they are pre-decisional; they must also be a part of the agency give-and-take -- of the deliberative process -- by which the decision itself is made." This holding by Vaughn -- that it is not sufficient merely to assert that a document is pre-decisional -- has been repeatedly confirmed in subsequent decisions. See, e.g., Jordan v. United States Department of Justice, 591 P.2d 753, 774 (D.C. Cir. 1978); Mead Data Central,

Inc. v. United States Department of Air Force, 566 F.2d 242, 257 (D.C. Cir. 1977). At no' point in its discussion of documents 1, 7, 8, and 9 of nppendix B does the partial denial allege that these documents are "part of the agency give-and-take -- of the deliberative process -- by which th" decision itself is made."

Nor can it be ascertained from the brief description of the subject matter of these documents which is provided in the appendices that they are part of the deliberative process.

Re Appeal From Initial FOIA Decision With respect to documents 2 through 6 of Appendix B and portions of document 30 of Appendix A, the partial denial of September 6, 1979 claims that Exemption 5 applies because the documents "contain advice, opinions, and recommendations of the staff". This characterization of the documents is conclusory in nature and is not supported by a description of the deliberative process of which it is suggested these documents were a part or of the role which these documents played in that process. In Vaughn v. Rosen, supra, the court required the Government to prepare a detailed description of the documents at issue and to

" classify and differentiate meaningf ully" amoung documents so that f actual material could be distinguished f rom evaluative or interpretive material. It also required the Government to define the deliberative process which was the asserted basis for the exemption and the role which the documents played in that process. In the absence of a similarly complete justification, the partial denial of September 6,1979 fails to meet the requirements for an exemption.

B. Exemption 1 Exemption 1 of the FOIA exempts from disclosure records that l are:

(A) specifically authorized under criteria established by an Executive order to be kept secret in the interest of national defense or foreign policy and (B) are in fact properly classified pursuant to Executive order.

5 U.S.C. S552(b)(1). As with Exemption 5, the Government bears the burden of proving that this exemption properly applies. See, e.g., Ray v. Turner, 587 F.2d 1187, 1210 (D.C. Cir. 1978).

1 The partial denial of September 6,1979 claims that, in addition to being exempt under Exemption 5, document 9 of Apendix B is exempt under Exemption 1, because it "has been classified pursuant to Executive Order 12065." A brief description of the subject matter of the document is provided in Appendix B.

However, this description is not adequate to establish that the document is properly classified, and there is no attempt beyond '

the conclusory claim of exemption in the letter to correlate the asserted justification with the contents of the withheld document. Like Exemption 5, Exemption 1 has been held to require l

See, e.g., Ray v. Turner, supra at 1214; Phillipi

v. CIA, 54 6 F. 2d 1009, 1013 (D.C. Cir. 1976).

III. CONCLUSION The partial denial of September 6, 1979 should be reversed and the appropriate office within NRC directed to release the documents withheld. This ir, especially so, since the release of the documents withheld would not'ad .sely affect the rights of any person and would not be contrary to the public interest. If this appeal is denied, the Agency should provide a detailed description of the documents withheld and its purported justification for the withholding of each as required under the FOIA.

the present relating to the Philippine Power Reactor Project.-

Wagman of my staff explained that documents subject to your request would be placed in the NRC Public Document Room (PDR),1717 H Street, N.W., Washington, DC, whe~re they would be available for inspection and copying. These documents are listed in Appendix A, enclosed, numbers 1 through 60.
