ME5961 AND ME6061)

Dear Mr. Pacilio:

By letter dated March 24, 2011 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML 110830837), as supplemented March 28, March 31, April 8, and April 10, 2011 (ADAMS Accession Nos. ML110870236, ML 110910156, ML111010578, and ML 111010199, respectively), Exelon Generation Company, LLC (EGC), submitted a relief request for Byron Station, Unit No.1, Facility Operating License No. NFP-37, requesting approval of an alternative repair technique which places a seal weld repair over the reactor vessel head penetration (RVHP) housings and J-groove welds. Subsequent supplements detailed repairs performed on RVHP Nos. 31, 43, 64, and 76, during the Byron Station, Unit 1, refueling outage B1 R17. By letter dated April 8, 2011, EGC supplement requested use of alternative requirements of the American Society of Mechanical Engineers Code,Section III, NB-4450, "Repair of Weld Metal Defects." Subsequently, by letter dated April 26, 2011 (ADAMS Accession No. ML 111170267), EGC withdrew the portions of the proposed request as they no longer applied. The U.S. Nuclear Regulatory Commission (NRC) acknowledges the partial withdrawal letter and has closed the associated TAC Nos. ME5961 and ME6061. TAC No. ME5961 was associated with the review to apply the alternative to all RVHPs and ME6061 was associated with the review of alternative requirements to NB-4450. The NRC staff reviews associated with repairs to RHVP Nos. 31, 43, 64, and 76 will continue underTAC Nos. ME5877 and ME5948.
