BYRON STATION, UNIT NO.2 - WITHDRAWAL OF RELIEF REQUEST RELATED TO CODE CASE N-729-1, TABLE 1 (TAC NO. ME1067)

Dear Mr. Pardee:

By letter dated April 2, 2009 (Agencywide Documents Access and Management System (ADAMS) Package No. ML091030449), as supplemented by letter dated October 14, 2009 (ADAMS Accession No. ML092880510), Exelon Generation Company, LLC (Exelon), submitted Relief Request (RR) 13R-17 for Byron Station, Unit NO.2.

Specifically, Exelon requested relief through Section 55a of Part 50 of Title 10 of the Code of Federal Regulations (10 CFR 50.55a) from the requirements of Table 1 of Code Case N-729-1 of the American Society of Mechanical Engineers Boiler and Pressure Vessel Code,Section XI, related to the extent of examination of the reactor pressure vessel head penetrations and welds.

Subsequently, in a letter dated December 17, 2009 (ADAMS Accession No. ML093520172), this request was withdrawn.

Based on the letter of December 17, 2009, we have terminated our review of RR 13R-17 and have closed TAC No. ME1067.
