OF APRIL 11, 2013, TELEPHONE CONFERENCE CALL BETWEEN NRC AND ENTERGY RE: ENTRY OF INDIAN POINT NUCLEAR GENERATING UNIT NO. 2 INTO THE PERIOD OF TIMELY RENEWAL

On April 11, 2013, a telephone conference call was conducted between Entergy Nuclear Operations, Inc., the U.S. Nuclear Regulatory Commission (NRC) Office of Nuclear Reactor Regulation (NRR), and NRC Region 1. The purpose of the call was for the NRC staff to understand Entergy's planned actions regarding implementation of the license renewal commitments and incorporating the aging management programs into the licensing basis prior to Indian Point Unit No. 2 entering the period of timely renewal.

Introductory Remarks

The NRC staff provided a brief background that prov ided the purpose and intent of the call. The items discussed were:

  • Due to the Waste Confidence Rule and Decision, the NRC will not renew the Indian Point 2 license prior to the end of the original 40-year license which occurs on September 28, 2013.
  • The timely renewal provision of 10 CFR 2.209(b), will permit Indian Point 2 to continue plant operations without a renewed license.
  • It is anticipated that Indian Point 2 may operate for a period of one year or more in timely renewal without a renewed license.
  • The current license renewal commitments by Indian Point 2 are regulatory commitments which may be changed or revised by the licensee. The licensee is not obligated to implement these commitments prior to entry into timely renewal.
  • In the event that the license renewal commitments are not implemented and the aging management programs are not incorporated in the licensing basis prior to the entry into timely renewal, over time the NRC staff would have increasing concerns regarding the assurance of adequate protection.
  • As a result, the staff would like to understand what actions are being planned by Entergy regarding license renewal commitments and incorporating the aging management programs into the licensing basis.

Entergy Presentation:

Entergy stated that by May 3, 2013, they will submit a letter that includes the following two

commitments;

  • They will submit a letter by the end of August stating that all Unit 2 license renewal commitments have been implemented. They plan to reference the list of commitments included in the second safety evaluation report (SER) supplement scheduled for July 2013. In the event that the NRC does not issue the second SER supplement on schedule, Entergy will reference an alternate document containing the commitments.

NRC Response:

The NRC staff indicated it was satisfied with the proposal and had no other questions. The staff stated that (1) a summary of this phone call would be prepared, and (2) following receipt of the licensee's planned letter of May 3, 2013, the staff would issue an acknowledgement letter. Both of these documents would be publicly available in the Agencywide Documents Access and Management System.
