Dear Senator Schumer :

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your April 6, 2023, letter regarding Holtec Decommissioning lnternational's (Holtec's) plans to release effluents at the Indian Point Energy Center.

Specifically, your letter raised concerns about changes to Holtec's plan for releasing treated water from the Indian Point Unit 2 spent fuel pool as well as, associated NRC inspections, details regarding effluent release reports, interagency collaboration, public and occupational dose limits, and communication and transparency.

The NRC's regulations require licensees to manage and demonstrate their liquid and gaseous effluent releases comply with prescribed dose limits. The licensee also is responsible for sampling, measuring, and reporting the releases. The effluent releases are required to be documented in a report submitted annually to the NRC. To date, all releases at Indian Point have been a small fraction of the allowable limits for such releases.

The enclosure of this letter contains the NRC staff's responses to your questions.

Additionally, in response to requests from you and the Indian Point Decommissioning Oversight Board, the NRC staff will support the Board 's meeting on April 27, 2023, by making a presentation and answering questions.
