TASKING IN RESPONSE TO THE CONCERNS PERTAINING TO GAS TRANSMISSION LINES NEAR THE INDIAN POINT NUCLEAR POWER PLANT - FOLLOW-UP ACTIVITIES -
OFFICE LEVEL On April 9, 2020, I forwarded to the Commission a final report titled U.S. Nuclear Regulatory Commission (NRC) Expert Evaluation Team on Concerns Pertaining to Gas Transmission Lines Near the Indian Point Nuclear Power Plant, dated April 8, 2020 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20100F635). I found the Evaluation Teams review to be thorough and well documented. I accept the Evaluation Teams recommendations and conclusions, as noted in my memorandum transmitting the report to the Commission (ADAMS Accession No. ML20099F775).
I task you to take immediate action within the areas of your responsibility to improve documentation, reviews, and analysis consistent with the recommendations in the Evaluation Teams Report. This immediate action will provide confidence in NRC procedures and practices pending the full implementation of the Evaluation Teams recommendations. You should focus on (1) documenting confirmatory analyses and enforcement petition reviews, (2) performing peer reviews of technical work products, and (3) formalizing and documenting interactions with other agencies when NRCs expertise or decisions will be cited by another agency.

Nieh, et al By separate memorandum (ADAMS Accession No. ML20104A388), I have tasked David Skeen, the Evaluation Team Lead, to coordinate the Agencys actions to address all the recommendations in the Report. He is directed to coordinate with the Director of the Office of Nuclear Reactor Regulation (NRR) and Region I on a staff communication to Entergy to revisit the assumptions Entergy made in its hazard analysis regarding the consequences of a postulated rupture of the 42-inch Algonquin Incremental Market pipeline and update its analysis, if needed. That communication should state that within 1 month of receipt, Entergy should provide a schedule for response. In addition, Mr. Skeen has been tasked to lead the agencys efforts to address the process and practice improvements identified by the Evaluation Team, coordinating with the offices that have responsibility for carrying out the programs. Specifically, Mr. Skeen and the respective offices are tasked to improve processes and practices for peer reviews of technical products, inspection support, petition reviews, pipeline analysis and coordination with other agencies. Actions in these areas will be executed by the appropriate offices after plans have been coordinated through the offices. Actions for your office will be ticketed after completion of these plans. I ask that you fully support him as he completes these taskings.
