Dear Mr. Gerard:

This is in response to your letter to Chairman Hendrie dated September 20, 1978.

Your letter urged the Nuclear Regulatory Commission to give serious considera-tion to the petition to intervene filed by three Indian tribes in the Skagit Nuclear Power Project proceeding. Since this matter may come before the Commission for its review, it would not be appropriate for the Chairman to comment on the petition to intervene at this time. Accordingly, your letter was referred to me for reply.

The petition for leave to intervene filed by the Indian tribes is presently being considered by the Atomic Safety and Licensing Board. In its deliberations, the Licensing Board will be considering the following legal pleadings submitted by the Indian tribes and the parties to the Skagit proceeding: 1) Petition to Inter-vene, dated June 13, 1978; 2) Applicants Answer to Indian Petition to Intervene, dated July 18, 1978; 3) NRC Staff's Answer to Petition to Intervene Filed On Behalf of the Upper Skagit Indian Tribe, the Sauk-Suiattle Indian Tribe, and the Swinomish Tribal Community, dated August 4,1978; and 4) Petitioner Tribes' Reply Brief to Answers of NRC Staff and Applicant, dated September 5, 1978. I am enclosing copies of these pleadings for your information.

In addition, on September 26, 1978, the Chairman of the Licensing Board requested that the petitioners and parties further respond to certain matters with respect to their legal positions in support of or in opposition to the petition to intervene. A copy of this letter is also enclosed.

We will keep you informed of future developments in this matter.
