The commitment is related to the large break loss of coolant accident (LBLOCA) analysis that applies an NRC approved emergency core cooling system (ECCS) evaluation model which includes the effects of fuel thermal conductivity degradation. The original commitment was made in a March 15, 2012 letter from DEK to the NRC (Reference 1). This letter was in response to a letter from NRC to DEK dated February 16, 2012 (Reference 2). DEK has evaluated this commitment under the guidance of NEI 99-04, "Guidelines for Managing NRC Commitment Changes,". and has concluded that the commitment no longer applies due to the current status of the Kewaunee Power Station (KPS). The original commitment was made to ensure the requirements of 10 CFR 50.46, "Acceptance criteria for emergency core cooling system for light-water nuclear power reactors," are met for KPS.
The original commitment stated the following:
By letter dated May 14, 2013, DEK submitted a certification of permanent removal of fuel from the KPS reactor vessel (Reference 3). KPS has permanently ceased power operations and all fuel has been permanently removed from the reactor vessel.

5000 Dominion Boulevard, Glen Mien, VA 23060 DominEoN Web Address: www.dom.com September 25, 2014 U. S. Nuclear Regulatory Commission Serial No.14-436 Attention: Document Control Desk LIC/CDS/RO Washington, DC 20555-0001 Docket No. 50-305 License No. DPR-43 DOMINION ENERGY KEWAUNEE, INC.

KEWAUNEE POWER STATION NOTIFICATION OF COMMITMENT CHANGE The purpose of this letter is to notify the Nuclear Regulatory Commission (NRC) that Dominion Energy Kewaunee, Inc. (DEK) intends to eliminate a commitment associated with Kewaunee Power Station (KPS). Based on the NEI 99-04 guidance, DEK concluded, that "Timely Notification of the Intended Change" to the NRC is appropriate in conjunction with changing this commitment. The original commitment stated the following:

"Before December 15, 2016, DEK will submit to the NRC for review and approvala LBLOCA analysis that applies an NRC-approved ECCS Evaluation Model that includes the effects of fuel thermal conductivity degradation."

The original commitment was made to ensure the requirements of 10 CFR 50.46, "Acceptance criteria for emergency core cooling system for light-water nuclear power reactors," are met for KPS.

By letter dated May 14, 2013, DEK submitted a certification of permanent removal of fuel from the KPS reactor vessel (Reference 3). KPS has permanently ceased power operations and all fuel has been permanently removed from the reactor vessel.

Consequently, as specified in 10 CFR 50.82(a)(2), the 10 CFR Part 50 license for KPS no longer authorizes operation of the reactor or emplacement or retention of fuel in the reactor vessel. Therefore, the commitment stated above is no longer relevant to the facility.
