DPR-43 RELATED TO DECOMMISSIONING QUALITY ASSURANCE PROGRAM On May 10, 2021, EnergySolutions, LLC (ES) and Dominion Energy Kewaunee, Inc. (DEK)

(collectively, the Applicants) submitted a license transfer application for the Kewaunee Power Station (KPS) (the LTA, Accession No. ML21131A141). The LTA stated that Kewaunee Solutions (KS) would develop a quality assurance program that would comply with 10 CFR 50.54(a). On September 29, 2021, ES submitted the KS Decommissioning Quality Assurance Program (DQAP) for NRC approval (Accession No. ML21277A246). On October 18, 2021, the NRG acknowledged receipt of the DQAP submittal (Accession No. ML21288A557).

To facilitate completion of the NRG's review of the L TA while the review of the DQAP is in progress, the Applicants propose the following approach, which also clarifies the September 29, 2021 DQAP submittal. First, KS commits that it will have in place a DQAP approved by NRG Safety Evaluation Report in accordance with the provisions of 10 CFR 50.54(a) prior to closing of the license transfer.

This is a regulatory commitment as noted in the attachment to this letter.

Second, the Applicants propose language for the NRG to use as a condition in its L TA approval Order, requiring KS to have in place an NRG-approved DQAP prior to closing of the transfer. The Applicants' proposed condition would state as follows:

Prior to closing of the license transfer, Kewanee Solutions shall have in place an NRG-approved Decommissioning Quality Assurance Program (DQAP) for Kewaunee Power Station consistent with the Safety Evaluation Report approving the DQAP.
