SUBJECT:  THE U.S. NUCLEAR REGULATORY COMMISSION RESPONSE TO DISPUTED NOTICE OF NON-CITED VIOLATION 05000395/2017201-01  Dear Mr. Lippard:
Thank you for your letter dated April 6, 2017, in response to the U.S. Nuclear Regulatory
Commission (NRC) Security Inspection Report 05000395/2017201, issued on March 10, 2017. 
In your response, you contested that the responders acted appropriately in accordance with established site procedures and, therefore, did demonstrate the appropriate use of force.  You additionally requested that Exercise One be characterized as successful rather than
indeterminate.  We appreciate the information you provided.  Upon consideration of that information, the Office of Nuclear Security and Incident Response has determined that the documented violation did not occur and the exercise should be characterized as successful.  A revised inspection report will be issued reflecting these decisions.  The enclosure to this letter provides the basis for our
conclusion. 
Enclosure transmitted herewith contains SUNSI.  When separated from enclosure, this transmittal document is decontrolled.
