Dear Madam or Sir:

By letters U-602520 dated December 14,1995 and U-602608 dated July 22, 1996, Illinois Power (IP) requested amendment of Operating License NPF-62, ,j Appendix A - Technical Specifications (TS) for Clinton Power Station (CPS). The '/  !

amendment request consisted of proposed changes to eliminate response time testing of

/O selected analog trip modules at CPS. Specifically, the requested amendment was to implement changes to TS 3.3.1.1, " Reactor Protection System (RPS) Instrumentation,"

r.nd TS 3.3.6.1, " Primary Containment and Drywell Isolation Instrumentation," for certain RPS and Main Steam Line isolation instrument channels. Elimination of periodic 'g[

response time testing of the pressure transmitter sensors associated with these instrument channels was previously proposed in IP letter U-602376 dated January 27, 1995, and was subsequently approved by the NRC via Amendment No. 98 dated March 9,1995.

The changes approved via Amendment 98 were supported by analyses provided in a topical report submitted in January 1994, by the Boiling Water Reactor Owners' Group (BWROG) and General Electric, NEDO-32291, " System Analyses for Elimination of Selected Response Time Testing Requirements." NRC review of NEDO-32291 was completed during 1994, and the NRC-approved version (NEDO-32291-A) of the topical report was issued in December 1994. Subsequent to that approval, the BWROG began preparation of a supplement to NEDO-32291 to extend the scope of the topical report analyses to support the elimination of response time testing for additional instrumentation, including trip units for the RPS and containment and drywellisolation actuation instrumentation. U-603112 l Page 2 of 3 continued applicability of NEDO-32291, IP prepared its own submittal to eliminate response time testing of the'RPS and the containment and drywellisolation actuation for CPS. Although the changes proposed in IP's submittal were consistent with those to be addressed in the supplement to NEDO-32291, IP's submittal (the December 14,1995 and July 22,19% submittals noted above) was intended to be a stand-alone submittal supported by NEDO-32291 without reference to the supplement to NEDO-32291.

Subsequent to IP's submittal for the additional instmmentation, the NRC identified a number ofissues concerning the draft supplement to NEDO-32291. In addition, the NRC informed IP that its submittal could not stand alone and that the issues identified for the supplement needed to be resolved to support review ofIP's submittal. Although the BWROG attempted to address the identified issues and then formally submitted the supplement to the NRC, additional issues were subsequently identified by the NRC, which resulted in the issuance of a significant request for information regarding the supplement. These events and actions have delayed approval time of the supplement. As such, the NRC has indicated that it will not consider any further review ofIP's submittal until all of the issues concerning the supplement to NEDO-32291 are resolved.

IP's most recent discussions with the NRC have indicated that IP should, at least for now, withdraw its application in light of the extended review period and the uncertainty of when all of the issues regarding the supplement to NEDO-32291 will be resolved. Although recent discussions with the BWROG indicate that the issues regarding the supplement can be resolved in the near future, IP has determined that its submittal should be withdrawn at this time. This decision is also based, in part, on the fact that an additional submittal will likely be required at any rate to incorporate information gained from resolution of the issues surrounding the supplement to NEDO-32291. ,

l Based on the above, IP hereby requests withdrawal ofits application for amendment of the i CPS Operating License, submitted via IP letter U-602520 dated Dece;nber 14,1995 and IP letter U-602608 dated July 22,1996. Please note, however, that withdraival of this request is made with the understanding that IP intends to resubmit its request for amendment at a later time (i.e.,

after resolution of the issues associated with the supplement to NE'X)-32291).
