MEMORANDUM AND ORDER (Granting Unopposed Motion to Dismiss Contention 1)

This proceeding concerns the subsequent renewal of the operating licenses for Turkey

Point Nuclear Generating Units 3 and 4. On March 7, 2024, we granted a hearing request filed

by Miami Waterkeeper and admitted for hearing a portion of Contention 1, a contention of

omission challenging the discussion of groundwater quality impacts in the Nuclear Regulatory

Commission Staffs Draft Supplemental En vironmental Impact Statement (Draft SEIS). 1 On

March 29, 2024, the Staff issued its Final Supplemental Environmental Impact Statement (Final

SEIS),2 and on April 4, 2024, the Staff filed an unopposed motion to dismiss Contention 1 as

moot.3

3 Joint Unopposed Motion to Dismiss Reformulated Contention 1 as Moot and Position of the

As admitted, Contention 1 states that the Draft SEIS fails to take a hard look at impacts

to groundwater quality because it does not include an explanation for the Staffs conclusion that

the uncertainty in retracting the hypersaline groundwater plume could result in moderate

impacts.4 The Staff asserts that the Final SEIS provides an explanation for the Staffs

groundwater quality impacts conclusion and therefore Contention 1 is moot and should be

dismissed.5 Miami Waterkeeper and Florida Power & Light Company agree. 6

In accordance with longstanding Commission precedent, a contention of omission must

be dismissed once the information claimed to be missing has been supplied. 7 The parties agree

that the Final SEIS contains an explanation for the Staffs conclusion regarding impacts to

groundwater quality that might ensue from a failure to remediate the hypersaline groundwater

plume.8 Therefore, we grant the unopposed motion and dismiss Contention 1 as moot.

Miami Waterkeeper has filed new and amended contentions challenging the Staffs Final

SEIS.9 We will address the admissibility of those contentions in a separate order, once briefing

is complete.10 Accordingly, we need not address the Staffs and Miami Waterkeepers position,

NRC Staff and Miami Waterkeeper Regarding Opportunity to File New or Amended Contentions (Apr. 4, 2024) (Motion).

expressed in the Staffs motion, that dismissing Contention 1 and keeping the proceeding open

to allow for the filing of new or amended contentions would be consistent with Commission

precedent.11
