MEMORANDUM AND ORDER (Requesting that Parties Address Applicability of Part 51 Amendments and Providing Notice of Dates for Possible Oral Argument)
On May 16, 2024, the Commission approved a final rule that would amend 10 C.F.R.
Part 51 regarding environmental reviews for license renewal applications to account for up to
one term of subsequent license renewal. 1 The rule is supported by a revised Generic
Environmental Impact Statement for License Renewal of Nuclear Plants. 2
Pending before us is Miami Waterkeepers motion to admit new and amended
contentions, along with an associated petition to waive 10 C.F.R. §§ 51.53(c)(3) and 51.71(d)
and 10 C.F.R. Part 51, Subpart A, Appendix B. 3 Florida Power & Light Companys (FPL) and

the Nuclear Regulatory Commission Staffs (Staff) answers to Miami Waterkeepers motion are
due June 3, 2024, and Miami Waterkeepers reply is due June 12. 4 Given that it is conceivable
the new rule amending Part 51 will become effective during the pendency of this proceeding, we
request that FPL and the Staff address in their answers the rules impact, if any, on this
adjudication. We request that Miami Waterkeeper address the same question in its reply.
In addition, we have not yet decided whether to hold oral argument on the admissibility
of Miami Waterkeepers proposed new and amended contentions. If we hold oral argument, we
anticipate scheduling it during the week of July 15, 2024. The Boards law clerk, Emily
Newman, will email the parties in the near term to determine their availability for oral argument
that week.
