E. Roy Hawkens, Chairman Dr. Michael F. Kennedy Dr. Sue H. Abreu In the Matter of Docket Nos. 50-250-SLR & 50-251-SLR FLORIDA POWER & LIGHT COMPANY ASLBP No. 18-957-01-SLR-BD01 (Turkey Point Units 3 and 4) November 20, 2018 ORDER (Revising Sequence of Oral Arguments)

On October 9, 2018, the Board issued an order that provided the sequence of oral arguments to be presented on December 4, 2018 in Homestead, Florida.1 On November 14, 2018, the Board issued an order that identified topics counsel should be prepared to address at oral argument.2 On November 16, 2018, the NRC Staff filed a letter to the Board requesting a change to the sequence of arguments to be presented.3 Having received no objections to the NRC Staffs request, we make the following revisions to the sequence of oral arguments:

1. The Board will first hear argument on the applicability vel non of 10 C.F.R. § 51.53(c)(3) to subsequent license renewal applications. First, we will hear from counsel for petitioner Southern Alliance for Clean Energy (SACE) and petitioners Friends of the Earth, Inc., Natural Resources Defense Council, Inc., and Miami Waterkeeper, Inc.

(collectively, Joint Petitioners), who will be allotted a total of 20 minutes (to include rebuttal, if any) and who can divide the time between themselves as they deem appropriate. We will then hear from counsel for the NRC Staff and then Florida Power &

Light Company (FPL), who will be allotted a total of 20 minutes and who can divide the time between themselves as they deem appropriate.

2. Thereafter, we will hear arguments regarding contention admissibility. We will first hear argument from counsel for SACE, who be allotted a total of 1 hour1.157407e-5 days <br />2.777778e-4 hours <br />1.653439e-6 weeks <br />3.805e-7 months <br /> and 10 minutes (to include rebuttal, if any), followed by counsel for FPL and then the NRC Staff, who will be allotted a total of 1 hour1.157407e-5 days <br />2.777778e-4 hours <br />1.653439e-6 weeks <br />3.805e-7 months <br /> and 10 minutes and who can divide the time between themselves as they deem appropriate.
3. The Board will then hear argument on contention admissibility from counsel for the Joint Petitioners, who will be allotted a total of 50 minutes (to include rebuttal, if any), followed by counsel for FPL and then the NRC Staff, who will be allotted a total of 50 minutes and who can divide the time between themselves as they deem appropriate.
