Dear Mr. Beasley,

On December 21, 2023 (Agencywide Documents Access and Management System Accession No. ML23348A196), the NRC staff sent ACU a letter enclosing a request for additional information (RAI) identifying additional information needed for the NRC staff to continue its review of several technical areas within ACUs construction permit (CP) application review. In this letter, the NRC staff requested that ACU provide a response to the RAIs by February 1, 2024.

By e-mail dated January 29, 2024 (ML24030A621), ACU requested an extension to respond to the NRC staffs December 21, 2023, RAI, such that the new response date would be March 1, 2024. Subsequently, on February 29, 2024, ACU submitted via e-mail another extension request (ML24061A024) to provide the response to the RAI by March 29, 2024.

On March 28, 2024, ACU requested via e-mail (ML24088A279) an additional extension of the due date to provide a response to RAI 2 by April 30, 2024.

The NRC staff accepts ACUs extension request dated March 28, 2024, and continues to encourage ACU to contact the NRC staff to discuss any questions related to RAI 2. A revised schedule for the review of the CP application will be transmitted, consistent with the December 21, 2023 letter.
