Report SWEC-SQN-42 SQN Emergency Plan Modification I. Introduction In a letter to TVA (reference 1), dated September 12, 1985, the Nuclear Regulatory Commission (NRC) identified that the agreement letter with the Soddy-Daisy Fire Department exceeded the biennial updating requirement in the SQN Radiological Emergency Plan (REP). This issue was addressed in the Stone & Webster Engineering Corporation (SWEC) systematic analysis, as follows:

Information on the background, corrective actions taken, verification methodology, verification analysis, completion status, and pertinent references for this issue is included in this report.

II. Verification of SWEC Issues A. Background The NRC identified during a review of Revision 20 to the SQN REP l

that the agreement letter with the Soddy-Daisy Fire Department exceeded the biennial updating requirement.

B. Corrective Actions Taken TVA submitted a response (reference 2) to the September 12, 1985, NRC letter on December 16, 1985. The response stated:

TVA maintains an agreement with an offsite fire-support s agency for Sequoyah Nuclear Plant (SQN). In fulfilling a commitment by B. M. Marks of TVA to W. E. Cline of your staff, the SQN Radiological Emergency Plan (REP) was revised to indicate that an agreement with the Soddy-Daisy Fire Department does exist and reference where the agreement is maintained. The agreement was referenced, instead of being included in the REP, primarily because Soddy-Daisy fire support is provided under a " formal-contract" format which includes several administrative details and not a one-page agreement letter. A review of the terms of the contract by TVA and Soddy-Daisy Fire Department is currently underway.

The REP revision was issued on September 30, 1985.

NRC's letter made reference to a biennial requirement to update letters of agreement with offsite support agencies as specified in SQN IPD, Muscle Shoals Emergency Control Center (MSECC) Implementing Procedure (IP) 12. This procedure is several years old and has undergone further revisions. The procedure was revised in September 1981 to change the procedure number to REP-IPD, MSECC IP-14. In June 1983 the procedure, REP-IPD, MSECC IP-14, along with the biennial requirement, was deleted.

II. Verification of SWEC Issues (continued) '

The agreements and/or contracts that TVA maintains with offsite support agencies are either "open onded" with no specified termination date, or the agreement and/or contract specifies the frequency for update by both parties. The frequency may vary depending on the agency.

In conclusion, we have fulfilled our verbal commitment to reference the offsite backup fire protection agreement for Sequoyah Nuclear Plant in the SQN REP. However, since the biennial requirement for updating offsite agreements is no longer in the IPs, and the Soddy-Daisy Fire Department contract is nonterminating, we do not believe that we are deviating from any requirement concerning the updating of such agreements.

C. Verification Methodology The SWEC concern identified for Employee Concerns Task Group (ECTG) verification was stated as follows:

ECTG reviewed the Sequoyah Compliance Licensing files for internal and external correspondence related to this issue, the applicable procedure, and the NRC status and tracking system for the issue.

This review of the pertinent documentation formed the basis for this verification activity.

D. Verification Analysis The ECTG review indicated that the issue has been adequately resolved. No additional concerns have been identified by the NRC since TVA's response was submitted. In addition, two NRC inspections (references 3 and 4) have been performed in the area of emergency preparedness since the TVA response was forwarded to NRC.

No violations or deviations were identified.

E. Completion Status Based on the response sent to NRC, no further action on this item is required. This SWEC concern is closed.
