E Yi[nUE M D ORDER (Scheduling A Prehearing Conference And The Taking Of Limited Appearance Statements)

On September 5, 1986 a telephone conference was held with representatives of the parties to consider: rescheduling of the prehearing conference previously set for September 3, 1986 and cancelled; enlarging the agenda of the prehearing conference to discuss a proposed hearing schedule in addition to the previously set subjects dealing with the admission of proposed contentions and consideration of a discovery schedule; and holding sessions for the taking of limited I appearances in conjunction with the prehearing conference.

After discussion and due deliberation the Board decided to hold a four-day session, one day of which will be concerned with legal issues and the remainder with the taking of limited appearance statements as 8609110286 860909 2 DR ADOCK 0500

provided for in 10 CFR 2.715(a). It is proposed to start with hearing from the parties on legal issues commencing at 9:30 a.m. on September 23, 1986 at Hauppage, New York, to be followed by the taking of limited appearance statements at locations in Suffolk and Nassau Counties, New York from September 24 through September 26, 1986. Limited appearance sessions are expected to be concluded during daytime and evening hours.

The times and places will be by further notice and announced as soon as accommodations can be obtained. .

The Board determined that the scope of the prehearing conference will be enlarged to include consideration of a proposed hearing schedule. Discussion on admission of the proposed contentions should focus on defining and applying fundamental flaw criteria, with emphasis i

on the permissibility of challenging the plan and the exercise, and the Federal Emergency Management Agency's evaluation.

As provided for in the 10 CFR 2.715(a) persons not parties to the proceeding will be permitted to make limited appearance statements at the sessions set aside for that purpose. The appearance on the issues may be by oral or written statement. As is customary each oral statement will be limited to five minutes, which should enable a large number of persons to be heard. Written statements that may be submitted are unlimited as to length.
