PROPOSED IMPOSITION OF CIVIL PENALTIES - $900,000 This is to inform the Commission that in accordance with the memorandum from Samuel Chilk dated December 13, 1985, a Notice of Violation and Proposed Imposition of Civil Penalties in the amount of Nine Hundred Thousand Dollars 4

($900,000) was issued on December 13, 1985 to Toledo Edison Company. This action was based on two violations which resulted in the failure of the auxiliary feedwater system on June 9,1985 to perfonn its intended function as a result of improper torque bypass settings for certain safety-related motor-operated valves, six additional violations involving failures in the licensee's maintenance, testing, training, analysis and corrective action programs which led to the June 9, 1985 failure; and two violations involving generic problems related to maintenance and troubleshooting of pipe supports which were included in this action although they were identified separately from the June 9 event.

The licensee was specifically informed of the enforcement action. The schedule of issuance and notification was:

Telefaxing of Notice December 13, 1985 Telephone Notification of Licensee December 13, 1985 Mailing of Notice December 16, 1985 A news release will be issued today. The State of Ohio will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
