July 9, 1985 EN 85-51 0FFICE OF INSPECTION AND ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Toledo Edison Company (Davis-Besse Nuclear Power Station Docket No. 50-346
Subject:
PROPOSED IMPOSITION OF CIVIL PENALTY - $100,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of One-Hundred Thousand Dollars
($100,000) will be issued on or about July 12, 1985 to Toledo Edison Company.
This action is based on three violations involving (1) the removal of the security-fire / radiation computer from service for approximately 2 hours2.314815e-5 days <br />5.555556e-4 hours <br />3.306878e-6 weeks <br />7.61e-7 months <br /> without proper notification being given to the Shift Supervisor so that timely compensatory measures to ensure adequate fire protection controls could be taken, (2) the failure of a non-licensed operator to monitor pipe leakage from the Startup Feedwater Pump / Turbine Cooling Water systems because the individual was asleep, and (3) the failure to maintain the required reactor power for the indicated reactor coolant flow roi.e.
It sheuld be noted that the licensee has not been specifically informed of the enforcement action. The Regional Administrator has been authorized by the Director, Office of Inspection and Enforcement, to sign this action. The schedule of issuance and notification is:
Mailing of Notice July 12, 1985 Telephone Notification of Licensee July 12, 1985 A news release has been prepared and will be issued about the time the licensee receives the Notice.
The State of Ohio will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
