I need to ask a vote to hold on less than one week's notice action on the following: SECY-86-2/3, Governnr Cuomo's hay 15 request for termination of Shoreham proceeding and affirmation of proposed order terminating NFS-Erwin proceeding.

The Commission is being asked to respond to a June 21, 1986 niotion by intervenors to reconsider CL.1 1 1 in which the Commission directed the appointment of a Licensing board to commence a hearing on the February 13, 1986 emergency preparedness exer:1ses for Shoreham.

miscellaneous filings by parties to the Sequoyah Fuels informal proceedings."

The Commission is being asked to approve an order -

responding to motions from parties to the two informal adjudicatory proceedings convened by the Commission to consider Sequoyah Fuels Corporation's request for licensing action.

All Counnissioners have approved an order which we circuiated earlier tcday denying the motions. In addition, thie Conimi ssi on or der authorizes the Secretar y to act for the Caiomission on minor procedural matters with respect to these informal pr oceedings in accordance with the authority the Secretary already has under 10 CFR Part 2.772.

COMMISSIONER ASSELSTINE: I have just a quick question. Wasn't there another item on the agency?

MR. PARLER: The General Counsel asked that that Liine be withdrawn. That was SECY-86-263 because a paper was filed in the Supreme Court yesterday saying t.h a t that -

particular matter was still being considered.

Our solicitor and I acree and would preter that because of that filing that the Commission not affirm this paper today right at tisis L i .rie . I t et k e it you all are in rasor.

MR. t1ALSCH : All the briefs have been filed. At this point, we might as welI wait for the Supreme Court to act before issuina the rulemaking. It is not going to be much -
