APPENDIX A Source Production & Equipment Company, Inc.

Docket No. 99901102/88-01 NOTICE OF VIOLATION As a result of the inspection conducted on May 24-26, 1988, and in accordance with Section 206 of the Energy Reorganization Act of _1974 and its implementing regulation 10 CFR Part 21, the following violations were identified and cate-gorized in accordance with the NRC Enforcement Policy, 10 CFR Part 2, Appendix C:

1. Section 21.6 of 10 CFR Part 21 requires, in part, that each corporation subject to the regulations in this part shall post current copies of (1) the regulations in this part, (2) section 206 of the Energy Reorganization Act of 1974, and (3) procedures adopted pursuant to the regulations in this part.

Contrary to the above, SPEC had not posted any of the required documents (88-01-01).

This is a Severity Level V violation. (Supplement VII)

2. Section 21.21 of 10 CFR Part 21 requires, in part, that each corporation adopt appropriate procedures to either (a) evaluate deviations or (b) inform the licensees or purchaser of such deviation; in addition, each

, corporation is required to adopt appropriate procedures to assure that a l director or responsible officer is informed if a basic component supplied l by the corporation contains a defect.

l Contrary to the above, SPEC had not written any procedures that respond to l this requirement (88-01-02).

This is a Seycrity Level IV violation. (Supplement VII)

3. Section 21.31 of 10 CFR Part 21 requires that each corporation subject to the regulations in this part assure that each procurement document for a basic component specifies, when oppitcable, that the provisions of 10 CFR Part 21 apply.

Contrary to the above, SPEC does not specify that 10 CFR Part 21 require-ments apply on purchase orders (P0s) because SPEC does not issue P0s(88-01-03).
