NOTICE OF VIOLATION r

R.E.C.

Corporation Docket No.

99901103/88-01 Mount Vernon, New York EA 92-101 During an NRC inspection conducted on October 25 and 26, 1988, violations of NRC requirements were identified.

In accordance with the " General Statement of Policy and Procedures for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the violations are listed below:

A.

Section 21.6,

" Posting Requirements," of 10 CFR Part 21 l

states, in part, that each corporation subject to the regulations shall post current copies of the following documents in a conspicuous position on any premises where the activities subject to this part are conducted:

(1) the regulations in this part, (2) Section 206 of the Energy Reorganization Act of 1974, and (3) procedures adopted pursuant to the regulations in this part.

Contrary to the above, at the time of the inspection R.E.C.

Corporation (REC) had not posted any of the required I

documents (99901103/88-01-01).

l This is a Severity Level IV violation (Supplement VII).

B.

Section 21.21, " Notification of Failure to Comply or Existence of a Defect and Its Evaluation," of 10 CFR Part 21 states, in.part, that each corporation subject to the regulations must adopt appropriate procedures for either evaluating deviations and failures to comply, or informing the licensee or purchaser of the deviation or failure to comply.

Contrary to the above, at the time of the inspection, REC i

had not developed procedures to either evaluate deviations and failures to comply, or inform the licensee or purchaser of the deviation or failure to comply (99901103/88-01-02).

This is a Severity Level IV violation (Supplement VII).

C.

Section 21.31, " Procurement Documents," of 10 CFR Part 21 i

states, in part, that each corporation subject to the i

regulations shall assure that each procurement document for a basic component specify, when applicable, that the provisions of 10 CFR Part 21 apply.

Contrary to the above, REC did not impose 10 CFR Part 21 requirements on purchase order 013950 dated June 8, 1987 issued to its subsupplier Texas Bolt Company.

t examination) in addition to the requirements of the material specification but failed to impose the requirements of 10 CFR Part 21 (99901103/88-01-03).

This is a Severity Level V violation (Supplement VII).

Before REC resumes business with the nuclear industry, REC is hereby required, pursuant to the provisions of 10 CFR 2.201, to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN:

Document Control Desk, Washington, D.C.

20555 with a copy, at the same address, to the Chief, Vendor Inspection Branch, Division of Reactor Inspection and Licensee Performance, Office of Nuclear Reactor Regulation.

should be clearly marked as a " Reply to a Notice of Violation" j

and should include for each violation:

(1) the reason for the i

violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.

Under the authority of Section 182 of the Act, 42 U.S.C.

2232, this response shall be submitted under oath or affirmation.
