NOTICE OF VIOLATION APPENDIX A Elgar Corporation Docket No.: 99900871/90-01
- San Diego, California During an NRC inspection conducted on March '12 through 15, 1990, violations of
- NRC requirements were identified.
In accordance with the " General Statement of Policy and Procedures For NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1990)theviolationsarelistedbelow:

Section 21.21, " Notification of failure to comply or existence of a defect," of 10 CFR Part 21 requires, in part, that each corporation subject to 10 CFR Part'2) edept :pprooriate procedures to provide for either evaluating deviations or informing the customer of the deviations in order that the ' customer may cause the deviation to be evaluated.
Contrary to the above, the NRC inspection identified that:

Elgar failed to adopt appropriate procedures to ensure that 10 CFR Part 21 was adequately implemented; specifically, Procedure No.
10005-01, " Evaluation and Reporting of Defects and Noncompliances Pursuant to 10 CFR Part 21," dated September 19, 1985, did not ensure that deviations were adequately evaluated and that Elgar's customers wereinformedofdeviations(90-01-01).

Elgar failed to adequately evaluate or inform its customers of deviations that were identified on Elgar engineering change notices (ECN's). Specifically, the following ECN examples identified design changes and errors which were not adequately evaluated or identified to Elgar's customers (90-01-02):
(1)ECN1680,IntegratedCircuit(IC)Socketproblemsregarding seismic fragility-(previously identified as Unresolved Item L
88-01-07 in NRC Inspection Report 99908871/88-01 and discussed in Section D.6 of this report).
(2)ECH2413,Improperinstallationofsemiconductordevices.
(3) ECH.2572, Interference between a terminal > block and front panel of 7.5 kilo-volt ampere (KVA) inverter regarding a lamp board l
assembly.
(4) ECN 3751, Numerous design changes to rectify problems on the driver logic board.
(5) ECH 4532, Capacitor design change to the static switch drive board.
(6) ECN 5322, Potential for electrical shorting of terminal block leads on 7.5 KVA inverter lamp board assemblies.
(7) ECN 5570, Fuse blowing problem corrected on the DC to DC L
converter board.
(8) ECH 7095, Incorrect termination of certain CMOS type IC logic gate input pins.

These are Severity Level IV violations (Supplement VII).
Pursuant.to the provisions of 10 CFR 2.201, the Figar Corporation is hereby required to submit a written statement or explanation to the U.S.
Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Chief, Vendor Inspection Branch, Division of Reactor Inspection and Safeguards, Office of Nuclear Reactor Regulation, within 30 days of the date of the letter transmitting this Notice of Violation. - This reply should be clearly marked as a "Re)1y to a Notice of Violation" and should include for each violation:
(1) t1e reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved.
_(3) the corrective steps that will be taken to avoid further violations, and.(4) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
