SAFEGUARDING HIGH LEVEL WASTE SHIPMENTS This is in response to your memorandum of December 3,1981. These are our comments:

1. Since Section 161(i) of the Atomic Energy Act does not address materials other than special nuclear material, and since Sec-tion 236 of the AEA does not address sabotage of nuclear wastes in transit, it may be desirable to seek new legislation on this matter. (Note that the House version of Section 236 did in fact cover byproduct material in a carrier. This language was deleted from the conference agreement for particular reasons.)
2. Is this study really needed? It is difficult to believe that potential health effects (or the potentials for sabotage) would be grossly different than for spent fuel shipments.
3. In regard to the S0W, suggest that Task 5 be deleted and per-formed in-house.
