FINDINGS AND DETERMI' NATION Authority to Use Cost Plus Fixed Fee Type Contract '

i In accordance with the requirements of Section 304(b) of the Federal Property and Administrative Services Act of 1949, as amended, 41 U.S.C. 254(b), and as implemented under Subpart 1-3.302 of the Federal Procurement Regulations, I make the following findings:

Findings

1. The Commission proposes to enter into a cost-plus-fixed-fee type contract with Battelle Columbus Laboratories for a project entitled, " Fission Product Release - Spent Fuel Shipment Sabotage."
2. The exact nature and extent of the work covered by the proposed contract and the proposed method of accomplishing that work cannot be established in advance but must be subject to change as the work progresses, and the cost of performing said work cannot at this time be forecast with a reasonable degree of accuracy so as to permit the undertaking of such work on a fixed price basis.
3. Due to the presence of unknown and unpredictable contingencies, the Contractor is prevented from quoting a price which the Commission would be willing to accept as a fair and reasonable price. By placing this contract on a cost basis, the Comission and the Contractor will estimate the effect of such uncertainties and remove from the cost to both parties any of such contingencies which do or do not actually occur.

Determination Pursuant to 41 U.S.C. 254(b), I hereby determine that the_ estimated cost of the contract, exclusive of fee, is $181,262; that the fee in the amount of

$13,792 is 8% of the total estimated cost; and that the fee is within statutory and administrative limitations.

Upon basis of these findings, I hereby determine that it is impracticable to secure supplies or services-of the kind or quality required without the use of a cost-plus-fixed-fee contract.
