SUBJECT:

REQUEST FOR INVESTIGATIVE ASSISTANCE - HARRIS NUCLEAR PLANT On September 19, 1984, we received notification from the Department of Labor that they were in receipt of a complaint from Mr. Chan Van Vo alleging violations of the employee protection provisions of the Energy Reorganization Act by Carolina Power and Light Company. A review of the complaint revealed that VO was an engineer working at the Harris Nuclear Plant and that he had been terminated from emoloynent at the plant on February 29, 1984. In addition, V0's complaint related that he had been assigned to inspect hangers for deficiencies and that he identified a large number of deficiencies which resulted in his supervisor telling him he was a liar and that he did not know how to perform his assigned duties.

After reviewing this complaint, a Region II letter was forwarded to VO requesting that he contact us so tnat we could discuss his concerns related to construction deficiencies at the Harris site. VO subsequently telephonically contacted B. Uryc and stated that he was represented by an attorney associated with the Government Acccuntability Project (GAP) and VO requested that any contact with him be arranged through the GAP attorney. In additic1, VO stated that he was preparing an affidavit which would describe his concerns in detail and that he would forward a copy of the affidavit to Region II. Inasmuch as VO had gone public with his concerns he is not to be considered a confiaential NRC source.

On October 10, 1984, we received a copy of V0's affidavit. It was forwarded to the Division of Reactor Safety for review to determine the technical concerns.

You were also provided a courtesy, copy of the affidavit by memorandum dated October 10, 1984. Our review of the affidavit resulted in two general technical areas being identified as matters requiring followup by the Region. There also appears, based on a review of his affadavit, that VO believes he was harassed and intimidated by CP&L because he raised safety concerns and allegations that critical construction documentation was, falsified.

I have directed my staff to make immediate arrangements to interview VO and that the interview should be coordinated with you. Because of the allegations of wrongdoing, that is, harassment and falsification of records, I am requesting that you take the lead in conducting a joint interview with members of my technical staff in order to fully develop and examine V0's concerns. My staf f has advised me that such an interview could logically be expected to take an extensive amcunt of time and therefore the interview should be transcribed by a court reporter. reviewed as quickly as possible because of the ASLB hearings which are currently undcrway. V0's concerns appear to be within the scope of the contentions before the ASLB board and hearing issues are normally handled on an expedite basis. I have directed Mr. Uryc to contact V0's attorney and arrange for an interview with VO for the week of October 28, 1984.

i You are requested to conduct this interview and provide a court reporter to transcribe the interview. I will provide technical assistance for the interview so that the technical issues can also be documented. You are requested to coordirate this request with Mr. Uryc so that appropriate coordination can be effectec with VO and his attorney.

Should +.his interview result in information indicating possible wrongdoing, you are requested to initiate an investigation to document and establish the facts as warranted. We will provide any technical assistance that you may require at your request.

I thanked hin for calling today and explained to him that we wanted to set up the VO interview. GUILD said that he was in a bit of a predicament because he had been informed that possibly he would be going to a 00L hearing with VO on 11-06-84. He said that he would like to do the interview this coming weekend.

I explained to GUILD that VORSE (01) had wanted me to infonn him that there were some con-ditions that VORSE was setting with regards to the upcoming interview. I told GUILD that -

VORSE wanted to hava only him and VO at the interview and that he wanted to conduct the interview at a neutral location such as a motel. GUILD stated that he would have to take some time to consider those conditions. I suggested that he discuss those conditions di- ~

rectly with VORSE and he said that he could do that. GUILD said that he would call.back on-Monday and we could discuss the matter further.

( ) erusa connummury acouseras as no +/- 1300 summace VORSE came to the office to advise that he had discussed the request for investigation with his Director (Mr. HAYES) and he was advised that the decision to conduct the inter-view was being left to him (V0RSE). He stated that he would do the interview; however, there were some conditions that he was setting for the interview. VORSE requested that when I talk to GUILD that I advise GUILD that VORSE was requesting that only he (GUILD) and VO be at the interview, and that the interview be conducted at a neutral location. V0RSE also stated that he would be trying to do the interview on Wednesday, 10-31-84. He also said that he would need at least two days to arrange for a court reported to be present at-the interview. I advised VORSE that I would pass his conditions on to GUILD when I talked _

with him. ,

NOTE: I contacted GUILD at approximately 1500, 10-26-84, and he stated that he was' getting ready to have a conference call concerning the hearing. He said that he expected the call would take approximately an hour and that he would call me back. GUILD did not return my call on 10-26-84. ,
