license amendment dated February 12, 1965 and the supplements thereto dated March 5, 1965 and April 23, 1965, authorises Northern States Power Company to operate the Fathfinder nuclear reactor located near steus Falls, South Dakota at steady state power levels up to a mas;eum of 190 megawatts theres1. Inclosed is a copy of a related notice which

(' has been sent to the Office of the Federal Register for publication.

You will note 'that Amendesat No. 3 to the license requires that you ,

provide proof of financial protection and receive notice of amendeest of Indemnity Agreement No. 3-27 prior to proceeding to power. We have ,

received from the insurers proof of financial protection of $3,400,000 -

and Amendment No. 3 to the indemnity agreement reflects this increase.

- Two copies of the assadment are enclosed for your acceptance. Flosse '

execute and return one copy to this office at your earliest convenience.

With regard to the financial protection, the population factor of the formula in 10 CFR 140.12 is calculated for us by the Bureau of the Census.

This information has not been received from the Bureau as yet. Pending  !

receipt of Bureau results, the levels of financial protection outlined in your letter of July 12, 1965 are being accepted and should be followed. .

is reasonable assurance that the health and safety of the public will not be endangered. A copy'of the related ABC safety evaluation was sent to you with our letter dated september 29, 1965.

. In view of the foregoing, pursuant to Section 50.59, 10 CPR 50, the Technical Specifications of Provisional Operating License No. DPR-11 are changed as set forth in Attachment A to this letter.
