The Pennsylvania Power and Light Company (PP&L) concurs with the terms of the Pennsylvania Department of Environmental Resources (Pa. DER) Sewage Treatment Plant agreement proposal of April 1, 1985. These terms include the following:

1. By signing the attached document, PP&L neither admi,ts nor degies the liability for the alleged incident described therein. However, PP&L agrees to pay a settlement of $2,000 to the Pennsylvania Clean Water Fund.

2. Three copies of the attached agreement signed by two PP&L corporate officers.

1) By April 15, 1985, PP & L shall make payment to the Pennsylvania' Clean Water Fund in the amount of Two Thousand ($2,000) Dollars by means of a check made payable to the "Ommonwealth of Pennsylvania".

2) Upon receipt of the above payment'and this signed a'greement, the Department agrees to waive civil penalty liability against FP&L for the March 7,1985 pollution incident. Ncthing in this agree-ment shall be construed to relieve PP&L of any liability for unknown effects of the discharge which may arise or be discovered in the future.

If our agreement prpi is acceptable, please nute all three (3) copies of this agreement signed by two corporate officers and affixed with the corporate seal and return them to our office at the letterhead address by April 15, 1985, alcng with The Clean Water Fund payment. We will then execute the agreement on behalf of the Department and return an executed copy to you for your records.
