Dear Governor Rockefeller:

I appreciate the concern you have expressed in your letter of October 8,1971, over the question of availability of Consolidated Edison's Indian Point Unit 2 to help meet the expected peak demand for electricity in liew York City next summer.

The Federal power Commission has furnished us information on the impact of delays in nuclear plant availability which lists hw York Stste among several areas expected to face serious power supply problems over the next 18 months.

We have accorded the highest priority to the processing of operating license applications for several nuclear units, including Indian Point Unit 2.

This application, as you know, is presently in hearing before en Atomic Safety and Licensing Doard.

As an interim measure, as authorized by the Board, the AEC issued a license to Consolidated Edison on October 19, 1971, which permits fuel loading and subtritical testing of the reactor during the period of the ongoing environmental review required by our regulations impicmenting the flational Environ-mental Policy Act (NEPA). The regulations also provide, under certain circumstances, for authorization of limited operation of a power reactor up to 20 percent of full power while the lkrA review is in progress.

In addition, in emergency situations or o mer circumstances where the public interest so requires, the Commission may authorize operation beyond 20 percent of full power.

In reference to your letter, I can assure you that the Commission is making every effort to minimize procedural delays in these priority cases, consistent with carrying out our ilEPA responsibilities.
