Emergency Plan Exemption Gentlemen:

My letter to you dated September 23, 1982 forwarded our Emergency Plan which was developed in accordance with Title 10, Code of Federal Regulations, Part 50, 5 50.54 (r). Since that time the experimental programs requiring the use of the CX-10 facility have been completed.

The reactor was last operated in September,1983, the fuel has been removed from the core tank and placed in storage.

At the present time the Lynchburg Research Center is ordering con-tainers to ship the fuel off site and a decommisioning plan is being developed for submittal at the end of July. These actions are being taken in preparation for the termination of the license.

In as much as the Lynchburg Research Center will be seeking authority to dismantle the CX-10 facility in the near future and at the request of Mr. ' Harold Bernard of your. office in a phone conversation on May 31, 1984; I herby request that the Lynchburg Research Center be exempted from the requirements of 10 CFR 50.54 (r).

Although the plan has been submitted in compliance with _5 50.54 (r) its approval and implementation would not serve a useful purpose because the facility is shutdown and its fuel will be removed from Lthe facility in the near future.
