INTERVENOR REQUEST FOR DISCOVERY IN THE MIDLAND QA HEARING On Thursday, April 7,1983, I hand delivered to HNR four copies of the request for production of documents which had been filed on the same day by intervenor Barbera Stamiris.
OELD has completed a preliminary legal review of the document and we are J
prepared to discuss with you objections we could make to the discovery request. However, there are other matters that must also be considered in determining how to respond to this reouest. As I have previously indicated, the Board has strongly advised the Staff to attempt to work with intervenor's in resolving their discovery request.
If intervenors are not satisfied there is no doubt that they will request a continuation of the April 26 hearing -
they have already clearly indicated that intent to the Licensing Board.
The hearing is scheduled to begin in slightly more than 2 weeks.
If we raise the legal objections we are entitled to raise, there is a risk that the Licensing Board will delay the hearing. The more effort we put into satisfying these discovery requests, the greater the chances that the hearing will not be postponed.
Mr. Eisenhut believes that there arc very good reasons wFy this her. ring should not be delayed. We would like to discuss this with you.
