Appendix (Notice of Violation) to Inspection Report No. 50-329/83-05 (OSC) and 50-330/83-05 (OSC) provides an item of noncompliance to 10 CFR 50, Appendix B.

NRC statement and our response are given below:

1 NRC STATEMElfr "10 CFR 50, Appendix B, Criterion V states, in part, " Activities affecting quality shall be prescribed by documented instructions, procedures, or drawings, or a type appropriate to the circumstances and shall be accomplished in accordance with these instructions, procedures, or drawings."

Bechtel Specification for Installation, Inspection and Documentation of ASME Sec-i tion III Pipe Supports, Hangers and Restraints for Piping in a Nuclear Power Plant, Specification No. 7220-M-362(Q) states in section 5.13.5, "After instal-lation, the snubber assembly shall be protected from physical damage due to nor-mal construction activities by providing wooden, heavy cloth, or other similar suitable protective covers."

Contrary to the above, mechanical snubbers installed in Unit I and 2 contain-ments were not protected from physical damage due to normal construction activi-ties by providing the required protective covers.

This is a Severity Level IV violation (Supplemen* II)."

CONSUMERS POWER COMPANY RESPOPSE In accordance with this Notice of Violation, an explanation of corrective action is as follows:

1) Corrective Action Taken and The Results Achieved NCR M01-9-3-157 was written on May 11, 1983 by MPQAD to document the non-conformance. Bechtel maintenance form F-10-359 is being written to cover j

maintenance of all installed Q and non-Q mechanical snubbers within their

jurisdiction.

f B&W Construction Company is preparing a Field Construction Procedure (FCP i

to address maintenance of mechanical snubbers within their jurisdiction.

2) Corrective Ac; ion To Be Taken To Avoid Further Noncompliance t

A 100% initial inspection of all installed mechanical snubbers will be performed by Bechtel & B&W.

Periodic inspections will be performed on a continuing basis theree';er.

l A Bechtel Task Force was formed on May 9, 1983 to structure, scope and l

eventually form a permanent storage / maintenance team. In addition to hav-ing responsibility for implementation of the storage /mainenance program, this team will perform an investigation to ensure that all types of mater-ials and equipment are adequately covered by the storage / maintenance pro-gram. Full implementation of the above will avoid further noncompliance.

3) Full Compliance Will Be Achieved As Follows:

Bechtel maintenance form F-10-359 will be implemented by May 23, 1983.

B&WCC will have their FCP issued for implementation by June 1,1983.

The 1007. initial inspection will be completed by both Bechtel and B&WCC by July 1, 1983. The investigation of other types of materials and equipment will be complete by August 1, 1983.

This refers to the routine safety inspection conducted by Messrs. J. Simon and A. Sather of this office on March 29-31 and April 1,1983, of activities at the Midland Nuclear Power Plant, Units I and 2, authorized by NRC Construc-tion Permits No. CPPR-81 and No. CPPR-82 and to the discussion of our findings by Mr. R. J. Cook and the inspectors with Mr. B. Peck and others of your staff at the conclusion of the inspection.

The enclosed copy of our inspection report identifies areas examined during the inspection. Within these areas, the inspection consisted of a selective examination of procedures and representative records, observations, and interviews with personnel.

During this inspection, certain of your activities appeared to be in non-compliance with NRC requirements, as specified in the enclosed Appendix.

A written response is required.

In accordance with 10 CFR 2.790(a), a copy of this letter and the enclosure (s) will be placed in the NRC Public Document Room unless you notify this office, by telephone, within ten days of the date of this letter and submit written application to withhold information contained therein within thirty days of the date of this letter. Such application must be consistent with the re-quirements of 2.790(b)(1). If we do not hear from you in this regard within the specified periods noted above, a copy of this letter, the enclosure (s), and your response to this letter will be placed in the Public Document Room.

The responses directed by this letter (and the accompanying Notice) are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.

NOTICE OF VIOLATION Consumers Power Company Docket No. 50-329 Docket No. 50-330 As a result of the inspection conducted on March 29-31 and April 1,1983, and in accordance with the NRC Enforcement Policy, 47 FR 9987 (March 9, 1982), the following violation was identified:

10 CFR 50, Appendix B, Criterion V states, in part, " Activities affecting quality shall be prescribed by documented instructions, procedures, or drawings of a type appropriate to the circumstances and shall be accomplished in accordance with these instructions."

B&WCC Quality Assurance Policy 9-QA-18 (Audits) Paragraph 11 states, in part, "The entire program shall be audited annually at each project site."

B&WCC Quality Assurance Policy 9-QA-07 (Control of Purchased Material and Services) Paragraph 4.6 states, in part, "An audit of a supplier shall be conducted every twelve months as a maximum."

Contrary to the above, B&WCC placed purchase orders and received material from suppliers which had not been audited for periods of up to thirty-four months, exceeding the twelve month requirement as specified in procedures 9-QA-18 and 9-QA-07.

This is a Severity Level IV violation (Supplement II).

Purruant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, it. eluding for each item of noncompliance: (1) cor-rective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full compliance 6

Licensee Action on Previously Identified Items a.

(open) Open Item (329/83-01-02; 330/83-01-02): The licensee had 2

reopened previously closed Nonconformance Reports (NCR's). As previously reported, NCR's which have been reviewed by the licensee had been revised to include the required information needed to justify the "use-as-is" disposition. No rework of completed con-struction was required as a result of this review. Review of the remaining NCR's is scheduled for completion by June 30, 1983. This item remains open pending the completion of the licensee's review.

i B&WJC issued twenty-seven purchase orders to nine suppliers in the three year period between February 1980 and February 1983. Contrary to the above, eleven purchase orders were placed with six suppliers which had not been audited within the preceding twelve months as required by B&WCC procedures 9-QA-07 (Control of Purchased Material and Services) and 9-QA-18 (Audits). The mean elapsed time between an audit and the placement of a purchase order was twenty-seven i

months and the maximum elapsed time was thirty-four months.

The inspectors informed the licensee that this unresolved item is to be escalated to an item of noncompliance as described in the l

Appendix of the report transmittal letter.

Review of Babcock and Wilcox Quality Manuals l

The inspectors reviewed the Babcock and Wilcox Construction Company (B&WCC) " Quality Control Manual CT49," Volumes I and II, dated March 7, 1980 and B&WCC " Quality Assurance Manual for the Fabrication and Installation of Class 1, 2, 3 and CS Items, CPC Units I and II "

dated June 13, 1979. A complete review was made of selected items within each manual. Information provided by this review formed the basis for additional inspections.

Inspection of Hanaers and Review of Associated QC Records A field inspection was made of hangers 1CCA-2-4-H1 and 2CCA-107-1-H5 to determine if these components were fabricated and are being installed in accordance with procedures.
