PROPOSED SCHEDULE RELEVENT TO THE MIDLAND EVIDENTIARY HEARING On Tuesday, December 28, 1982, it was necessary to have a conference call with the Licensing Board concerning the Midland schedule. Consumers testimony on the subject of Quality Assurance was due to be filed on Thursday, December 30th, and they needed to ask for an extension of time.

I advised the Board that I would not be able to discuss this proposed schedule with NRR until the first week of January and that the schedule remained tentative until that discussion took place. The Board suggested that we have another conferen'ce call at 10:00 a.m. on Wednesday, January 5, 1983 to advise the Board of the results of the discussion with NRR. Please let us know, as soon as possible, whether the schedule set out below is agreeable.

The following schedule was discussed with the Board:

January 17 CPC will file their testimony on issues to be considered at a one week hearing scheduled to begin on February 14, 1983.

Issues arising from the soils hearing to be addressed at that hearing are: the Staff's allegation concerning a material false statement, the remaining portions of contention 4, Staff response to Harbour questions, the non-conformance reports addressed by CPC witnesses Bird and Wheeler, seisraic shakedown on structures other than diesel generator building. We also propose to address three OL issues. Thesa are Sinclair #3 (StaffevaluationofClass9 accidents),Sinclair#28(water hammer), and Sinclair #30 (effect of use of pond water on steam generator tubes).

January 31 NRC Staff will file testimony on issues to be addressed at the February 14, 1983 evidentiary hearing.

February 14 Evidentiary session intended to complete all issues involved in the the soils hearing. We will start on Monday, February 14 and continue through Saturday, February 19 if necessary.

February 15 This is the scheduled date for issuance of the Region III inspection report concerning the October - November 1982 inspection at the diesel generator building. The report will contain significant QA findings.

February 28 CPC will file all of its quality assurance testimony to be heard at the evidentiary session expected to begin on April 12, 1983. This will include their responses to quality assurance testimony filed by the Staff on October 29, 1982 and their response to the Staffs inspection report which is expected to be made public on February 15, 1983.

March 4 Region III will file supplementary testimony which will include Mr. Keppler's most recent assessment of QA at Midland.

It will include discussion of the construction completion plan which CPC is expected to file in January 1983.

March 18 CPC will file testimony responsive to the testimony filed by the Staff on March 4,1983.

April 12 The evidentiary hearing on quality assurance will commence.

It is scheduled to last 2 weeks. This hearing may not conclude all quality assurance items. The reason for this is that the Office of Investigation has recently advised that their investigation of six affidavits provided to the NRC Staff by gap would not be completed until mid-March. Another issue outstanding with the Office of Investigation is whether CPC violated a Board Order. The investigation of that matter is not scheduled to be completed until the end of March. There are other matters relevant to the Midland proceeding which are being investigated by the Office of Investigation.

Mr. Keppler agrees with the schedule set forth above.
