(BEPC), and Tex-La Electric Cooperative of Texas, I

Inc. (Tex-La) hereby apply for forty year, class 103 licensas to operate two nuclear power reactors at their Comanche Peak Steam l Electric Station site in Somervell and Hood counties, Texas. Each reactor will have an iriitial nuclear output of 3411 Mwt and a design rating (net nuclear) of 3565 Mwt. The Applicants also apply for appropriate source, by-product, and special nuclear material licenses for the project. TUEC, as lead Applicant and as agent for TMPA, BEPC, and Tex-La, provides the following information in accordance with 10 CFR 50.33.

Texas Utilities Electric Company, et al.

TUEC, a subsidiary of Texas Utilities Company (TUC0), will operate the Comanche Peak Steam Electric Station (CPSES) as agent for the other Applicants. 3 TUEC is incorporated under the laws of the State of Texas. TUEC and the othei Applicants maintain their headquarters at the addresses shown in (b) above.

The transmission lines of the Texas Utilities Electric Company are interconnected and constitute an integrated system through which the output of the generating stations is distributed. This output provides retail electric service to 345 cities and towns, and wholesale electric service to three municipal electric systems and 33 rural electric cooperatives.

As of September 30, 1983, TUEC had a total net capability of 17,957,000 kil owatts. Texas Utilities Electric Company supplies the electric energy needs for more than 4 million people in 87 counties in North 3 Central, East and West Texas.

Texas Municipal Power Agency On May 8,1975, the Legislature of the State of Texas enacted Section 4a of Article 1435a, Vernon's Texas Civil Statutes. Article 1435a provides that public or private entities in the State may jointly plan, y finance, acquire, construct, own, operate and maintain generation and transmission facilities. Section 4a provides that public entities owning electric generation facilities may create joint power agencies with the authority to issue electric revenue bonds for any projects that they may undertake. corporations, political subdivisions, and bodies politic and corporate of the State of Texas.

TMPA was created in July 1975 by, and to act in the interest of, the Cities of Bryan, Denton, Garland and Greenville, Texas (Cities) in obtaining the economic advantages of jointly financing, constructing and operating large generating units to supply the growing energy needs of the Cities. TMDA has formulated and is now implementir.g a 10-year power supply program (1978-1987). The major generation facilities of this program are the lignite-fired 400 MW Gibbons Creek Steam Electric Station scheduled for service in 1982 and the Agency's 61/5% ownership interest in CPSES. At the present time TMPA is a development stage enterprise. It does not operate any generation, and operates only minor transmission but expects to become a wholesale supplier to the Cities as the facilities noted above come into operation.

/7 Brazos Electric Power Cooperative, Inc., was incorporated under the Rural Electric Cooperative Act of the State of Texas in 1941. Brazos was formed for the purpose of furnishing dependable, economical, wholesale power and energy initially for eleven rural electric distribution cooperatives of Texas. Brazos is presently owned by and serves the following nineteen rural electric distribution cooperatives which were organized and are operating under the Rural Electric Cooperative Act of the State of Texas:

Brazos has, from its inception, provided generation and transmission services to its members and presently has in operation three generating I

stations with a combined output of 465 MW of thermal generation, 53 MW of hydro generation and is presently constructing 400 MW of thermal generation through assc::iation with another Texas cooperative. Brazos has approximately 2000 miles of transmission facilities serving its members in 55 central and north Texas counties. The 3 4/57 ownership interest in CPSES will integrate into Brazos' long-range generation plans and provide Brazos with a proper mixture of fuels for use in meeting its future generation requirements. Electricity generated by the Comanche Peak project for Brazos will be distributed among the above member cooperatives, and the cities of Bartlett, Granbury, Hearne, Sanger, Seymour, Weatherford, and Whitesboro.

Tex-La Electric Cooperative of Texas, Inc.

Tex-La is a generation and transmission cooperative which has been recently organized under Article 1528b, Vernon's Annotated Texas Statutes and the Electric Cooperative Corporation Act of the State of Texas. Tex-La was organized to engage in rural electrification by the generation and transmission of electric power and energy to and for its members:

TUEC proposes to operate the nuclear electric generating plant, 3 consisting of two (2) generating ur.its utilizing pressurized water

! reactors, at the Comanche Peak site. Each generating unit will have an l estimated gross electrical output of 1,161 Mwe. Each reactor will have an initial nuclear output of 3,411 Mwt (an additional 14 Mwt will AMENDMENT 3 JANUA2Y 2ii,1984 l

originate from non-nuclear sources). The containment, engineered safety features, and certain postulated accidents are designed and/or evaluated for a r.et core output of 3,565 Mwt. The facilities will be used for the generation of commercial electric energy for transmission and sale as provided in section 105.c of the license conditions which  ;

3 TUEC has agreed to accept.

The Comanche Peak Steam Electric Station will be" located in Somervell County, Texas, 65 air miles southwest of the Dallas-Fort Worth Metropolitan Area in North Central Texas. Details concerning the

! plant, the site, and the attendant environmental considerations are contained in the Final Safety Analysis Report (FSAR) and the Environmental Report (ER), which constitute part of this application.

(f) Deleted (g) Radiological Emergency Response Plans The radiological emergency Response Plans of the State of Texas and the counties of Somervell and Hood have beend submitted separately.

(1) Regulatory Agencies and Trade and News Publications Neither TUEC nor the other Applicants are subject to the plenary 3 jurisdiction of the Federal Energy Regulatory Commission.

All municipalities in Texas are empowered by statute to regulate rates

! and to prescribe rules and regualtions under which services are 1

rendered by electric utility companies within their city limits. For 7

I is empowered to regulate rates and to prescribe rules and regulations for areas outside the limits of municipal corporations, and within the i

regulatory authority to the commission. The PUC also has jurisdiction j over appeals from decisions of municipalities with respect to regulation of rates and service. The rates of the joint Owners have been formally adopted or approved by the appropriate regulatory agency, with the exception of the TMPA which is not subject to outside

regulatory approval.

TMPA has taken the position that under the Texas Public Utility Regulatory Act the PUC does not have jurisdiction over it. In Docket No. 41 of the PUC, issued on October 8,1976, the PUC found that it did not have jurisdiction to require TMPA to obtain certificates of convenience and necessity before building facilities within the State.

4 In an opinion dated July 22, 1980, the attorney general of Texas ruled that PUC has no original or appellate jurisdiction over the rates of the TMPA. The statute under which TMPA was created, and which reserves 1 1 to the State the right to regulate the rates of TMPA, provides that the State will not limit the powers of TMPA to establish and collect rates i

'I The cities who purchase from TMPA have original jurisdiction over the electric rates, operations and services of their own systems within their boundaries. The Attorney General of Texas has rendered an opinion that the PUC has no appellate jurisdiction over such rates.

I The respective original and appellate jurisdictions of the Cities and the PUC with respect to rates, operations and services of the Cities'

! electric systems outside of their boundaries is not clear at this time, but the Statute appears to give the PUC no such original jurisdiction, and appellate jurisdiction only with respect to retail sales and not sales between one city and another. The Statute provides that after September 1, 1977, any city may surrender to the PUC jurisdiction over utility rates, operations and services, but is not clear whether this includes the right to surrender jurisdiction over its own municipal system.

(j) 10 CFR 50.37 Agreement The application does not contain any Restricted Data or other defense information, and it is not expected that any will become involved.

However, TUEC agrees that it will appropriately safeguard such 3
