MOTION OF DAARE/ SAFE TO COMPEL SUPPLEMENT TO OR REVISION OF FINAL ENVIRONMENTAL STATEMENT Intervenor DAARE/ SAFE, by its undersigned attorneys, hereby moves the Board to enter an order requiring the NRC staff to supplement or revise the Byron Final Environmental Statement (FES),

issued in April 1982.

The grounds for this motion are as set forth in the Petitions of Rockford League of Women Voters for Waiver of or Exception to Need for Power and Alternative Energy Source Regulations 10 CFR $$51.23(c) and 51.53 filed July 6, and Petition of DAARE/ SAFE for Waiver of or Exception to Alternative Energy Source Regulations 10 CFR S$51.23(c) and 51.53(c) filed Jidy 30, 1982, and the exhibits to those petitions.

A new or supplemented FES is required for Byron because of changed circumstances and newly-developed information which have become known since the date of the issuance of the FES. See DAARE/ SAFE petition at p. 6-7: DAARE/ SAFE's Reply to Responses of Commonwealth Edison and NRC Staff to Rockford
