These concerns sven' to focus primarily upon the amount of inspector discretiori exercised for NCV's to provide a reliable basis for proper evaluation of licensee past performance.

It is not the iritent of EGM 89-04 to provide an all encompassing data base, nor to supersede other inspection redules that review a licensee's problem identification and corrective action program.

I continue to believe that developsent of such inspection guidance is Dest left to the appropriate picgram of fice, and implementation of the inspection program lef t to the able discretion of the Regions.

The purpose of the EGM guidance is to (1) explain why we are not citing a violation if it is included in an inspection report, (2) track the violation so that we don't repetitively exercise discretion for the same issue and (3) allow us to consider in enforcement history the more significant licensee.
