NUCLEAR MATERIALS SAFETY BRANCH PROCEDURE NO. 7 -
TELEPHONE CONTACTS Attached to this memo is the Nuclear Materials Safety Branch (NMSB) Procedure No. 7 describing a newly developed program for the performance and documentation of telephone contacts for Priority 6 and 7 licensees.
This program was established using guidance from Manual Chapter 2800 and should serve as a useful tool for maintaining contact with Priority 6 end 7 licensees never inspected or inspected infrequently.
This procedure should be placed with NMSB Procedure Nos. 1-6 previously issued.
As a supplement to this, specific training will be provided to those involved with the program in the near future.

Telephone Contact Procedures for Priority 6 and 7 Licensees Objectives / General Guidance: This procedure was established to maintain contact with those Priority 6 and 7 licensees who have never been inspected or inspected. infrequently.
either junior inspectors (Grades 5-12) and/or suminer helpers / interns.T These may also be conducted by other inspectors / reviewers, but only if the Region has completed inspections of the higher priority licensees, allegations, and speciti inspections.
It is our goal to complete approximately 100 telephone contacts during the remainder of FYS9 and continue the program in the future.
Of importance and in accordance with Manual Chapter 2800, these telephone contacts are not to be considered inspections.
Therefore, the results of these activities can not be recorded on an NRC-591 or in a Notice of Violation.
We can, however, document our effort as routine inspections on RITS and file a form 766 documenting our effort as an inquiry.
The Technical Assistant DRSS, will oversee the program management functions (tracking) of this procedure.

The following procedures should be followed for. conducting telephone contacts.
t 1.
Select the licensee to interview, using the pink computer sheets designating those licensees not. inspe'eted since 1970.. Updated computer sheets will be reissued quarterly. The'prioritization for the selection process should be (1) those licensees scheduled for an inspection with no previous inspection; (2) those licensees never inspected, with no scheduled inspection', and (3) those who, at one time (prior to 1970), had an inspection conducted with a "next inspection" date scheduled as 9999.

Pull the license file and review the file to determir.e the person to contact for information needed to complete the interview questionnaire (Enclosure 1).

Telephone the licensee, complete the questionnaire and determine whether or not significant regulatory requirements are being met.
Note that not all licenses require each procedure mentioned in the questionnaire.

If significant problems are identified during the course of the telephone interview, the person filling in the questionnaire should promptly notify i
the responsible Section Chief to determine what course of action should be taken (i.e., CAL, Order, dispatch of an inspector, etc.).
Examples of significant problems may be:

Personnel exposures in excess of the regulatoly limits; a.

Loss of licensed material; Indications of source 1eakage; c.

Abandonment of material or inability to contact licensee; Any event the licensee considered unusual (fire, floods, etc.); and e.

Prepare a 766 (documented as an inquiry) and submit the entire package to the appropriate Section Chief for review and signature of the transmittal letter.
8.
If responses are required of the licensee, the same procedures currently used for' tracking NOV responses will be used by the Materials Administrctive staff to maintain the track of response due dates.
