CRGR REVIEW OF 20.403 NOTIFICATION OF INCIDENTS RULEMAKING The purpose of this memorandum is to advise you chat the Office of Nuclear Regulatory Research (RES) and Nuclear Material Safety and Safeguards (NMSS) are in the process of finalizing a proposed rule to be published in the Federal Register for comment.
The proposed rule concerns 10 CFR 20.403 - Notification of Incidents. The paragraph below provides a brief sumary of the proposed rulemaking:
NRC is proposing to amend its regulations to clarify licensee reporting requirements regarding the Notification of Non-Reactor incidents. This action is needed because licensees do not always report incidents that the NRC staff considers to have significant implications for public health and safety. The proposed rule if promulgated will affect materials licensees under 10 CFR Parts 20, 30, 40, and 70.
Comments on the draft proposal were previously requested from selected Divisions in NMSS, OE, AEOD, NRR, GPA, OGC, and ADM.
In addition, comments were requested from the five NRC Regions as well as the Agreement States. Appropriate coments have been incorporated into the proposed rulemaking to the maximum degree possible.
Both RES and HMSS agree that this rulemaking does not concern power reactor l
licensees. As such it does not appear to come under the umbrella of the CRGR l
- charter, in light of this, we are requesting that this rulemaking be exempt from CRGR review. The package is now in the Office concurrence process; therefore, I would appreciate your response regarding our determination by i
