PROPOSED RULE, 10 CFR FARTS 20, 30, 40, and 70,

" NOTIFICATION OF INCIDl:NTS" The subject _ proposed rule contains numerous information collection requirements that must be submitted to the Office of Management and Budget (OMB) for review no later than the date the )roposed rule is published in the Federal Register.

Publication of the rule is >eing placed on hold until the OMB submittal package has been approved by the agency's Designated Senior Official for Infonnation Resources Management. There are several areas of the rule that must be modified to conform with OMB and NRC information collection regulations and guidelines.

. The following is a brief list of those required changes:

M The " Paperwork Reduction Act Statement" must be revised to reflect the inclusion of information collection requirements in the proposed rule.

Reference item 3, enclosure 2, for the appropriate statement, b

• must be added as the second paragraph of the " Paperwork Reduction Act Statement."

The " Regulatory Flexibility Certification" as written states that the I-

" proposed rule is not adding any new reporting requirements to the l

Code of Federal Rcgulations"; however, it seems that requirements are i

being transferred from 10 CFR 20 to newly created subsections in 10 l

l CFR Parts 30, 40, and 70. This may require a rewording of the

" certification."
