In July 1987, the Director of the Office ot Enforcement sent a memorandum to the Director of Nuclear Regulatory Reseerch citing the need to clarify licensee reporting requirements un@ r 10 CFR 20 A03. The offices of OE, 0GC, i
NMSS and RES have reviewed the appropriate 10 CFP and agree that clarification is needed with respect to reporting concerning the " loss of operations and damage to property."

Regulatory Research sent a memorandum to the ED0's office in early February

1988.which outlined the problem and provided the RES recommendation to proceed with a proposed rulemaking to clarify licensee reporting requirements.
In mid-February 1988, the E00 concurred with the initiation of the proposed rulemaking.
Since mid-February, OE, NMSS, and RES have met on several occasions to try and draft a set of words to modify the current 10 CFR 20.403. The latest meeting 3"
was held on May 12, 1987. At this meeting a consensus was achieved relative to the specific revisions needed to 20.403. The enclosure to this memo constitutes our suggested draft revision of 20.403.
The purpose of advising you of this action is to insure that the proposed revisions to 20.403 do not adversely affect any regulatory activities in NRR.

s-May 12, 1988 20.403 Notification of Incidents (Proposed)
(a) Immediate notification.
Each licensee shall immediately, and in no case later than one hour, report any event involving licensed material possessed by the licensee that may have caused or threatens to cause:
(3) A loss of one working week or more of the use or operation of any device, equipment, room, or building in which licensed material is used or stored; or (4) Consequences such that the sum of the costs of (i) damage to any device, equipment, room, or building in which licensed material is used or stored and (ii) required decontamination, cleanup, and disposal could reasonably be expected to exceed $200,000.
(b) Twenty-fourhournotification.
Each licensee shall within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> report any event involving licensed material possessed by the licensee that may have caused or threatens to cause:
(3) A loss of one day or more of the use or operation of any device, equipment, room, or building in which licensed material is used or stored; or (4) Camage to equipment or devices containing licensed material that could reasonably be expected to exceed $2,000, or required decontamination, cleanup, and disposal that could reason?bly be expected to cost in excess of $2,000; or (5) Any decontamination or cleanup activity that takes more than 1? hours to complete from the time the activity is initiated.
