DIVISIONAL. REVIEW 0F'THE PROPOSED RULEMAKING -

NOTIFICATION OF INCIDENTS We have reviewed the proposed rulemaking package and enclosures, and we have the following ccmments:

1.

Current regulations require licensees without an installed Emergency Notification System (ENS) to make required notifications by telephone to the NRC Operations Center and by telegram, mail gam or facsimile to the w sI-appropriate regional office. The proposed ch uges will maintain this 3

requirement for double notification. Those ' licensees with an installed ENS are not required to make the additienel notification by telegram, 7

?'mailgram or facsimile.

It is not clear what benefit to public health or g, ; B'. % safety is gained by this additional notification.

If the staff believes that_this additional notification is critical, what provision exists or will be implemented to assure that telegrams, mailgrams or facsimiles delivered after working hours are promr,tly received, evaluated, and acted on?

MNE 2.

Information Notice 85-78, " Event Notification," provides power reactor licensees with guidance on the information that will be requested by NRC when making event notifications reqtired by 10 CFR 50.72.

Although the information that NRC will need from naterials or fuel facilities will not be the same as in this notice, the licensees would benefit if guidance is provided on the information they should be prepared to provide.
